Overview

The Statutory Rules 1969 No. 13, made under the Public Service Act 1922-1968, introduce amendments to the Public Service Regulations, specifically addressing the salaries of certain officers within the Fourth Division of the public service. Enacted by the Public Service Board and subsequently approved by the Governor-General, these regulations aim to provide a structured approach to determining the salaries for student nurses and other specific officer roles across various departments. The policy objective is to ensure that remuneration is fair and commensurate with the officers' experience and the responsibilities of their positions, thereby maintaining an equitable pay structure within the public service framework.

Scope and Application

The Public Service Regulations 1969, as an amendment to the Public Service Act 1922-1968, apply to officers within the Commonwealth public service, specifically those listed in the amended First Schedule. This includes various roles across different departments and states, each with specified salary scales. The regulations also introduce new categories of officers, such as Student Nurses and various technical instructors, with their own salary structures based on experience and location. The amendments set specific salary rates for these roles, ensuring consistency and clarity within the public service remuneration framework. The scope of the regulations is nationwide, impacting all Commonwealth public servants, including those in state-specific departments. The regulations do not explicitly state any exclusions or exemptions, implying that all officers within the amended categories must adhere to the new salary provisions. The Public Service Board has the authority to make further adjustments through subordinate instruments, ensuring the regulations can be updated as necessary to reflect changes in the public service landscape.

Key Provisions

The main operative sections of these Regulations, under the Public Service Act 1922-1968, primarily involve amendments to the existing Public Service Regulations, particularly focusing on the salary rates for certain public service officers. Regulation 106 is amended to introduce a new sub-regulation (7a), which provides a specific salary scale for female student nurses under the age of twenty-one in the Department of Health, Northern Territory (Regulation 1). The First Schedule is amended to replace several existing groups with updated salary ranges for various officer categories across different departments and locations (Schedule). Additionally, the Second Schedule is amended to remove a specific salary limit for an officer within Item 42 (Regulation 3). These Regulations impose specific obligations on the Public Service Board, including the responsibility to determine and set salary rates for certain officers based on their period of service. For instance, the Board must ascertain the annual salary for female student nurses under the age of twenty-one in the Department of Health, Northern Territory, according to the newly introduced scale (Regulation 106(7a)). Furthermore, the Board must update and maintain the First Schedule to reflect the new salary ranges for various officer categories (Schedule). These obligations ensure that public service officers are compensated appropriately according to their roles and experience. Breach of these Regulations may result in various civil or administrative consequences, although specific penalties are not detailed within the text. Non-compliance with the salary determinations and updates may lead to disputes regarding remuneration, which could be resolved through administrative or judicial processes. The Regulations themselves do not explicitly outline penalties for non-compliance, but such breaches could potentially be addressed under broader public service governance frameworks or through specific administrative actions. The absence of explicit penalties in the text suggests that enforcement may rely on broader regulatory or administrative mechanisms.
