REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922–1955.*

WHEREAS by sub-section (3.) of section four of the Salaries Adjustment Act 1955 it is provided that regulations may be made under the Public Service Act 1922-1955 for purposes of or in relation to a reclassification referred to in sub-section (1.) of that section of officers to which the latter Act applies and that regulations so made shall be deemed to have come into operation on the twenty-third day of December, 1954:

Now therefore the Public Service Board, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1955 and by virtue of the Salaries Adjustment Act 1955, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Parts.

Amendments of the Public Service Regulations.*

1. Regulation 2 of the Public Service Regulations is amended by omitting the words—

"Part IV. —Officers of the Second Division.

Part V. —Officers of the Third Division.

Part VI. —Officers of the Fourth Division.

Part VIa.—Variation of Salary—Officers of Second, Third and Fourth Divisions.

Part VIb.—Salaries payable to Adult Officers of the Fourth Division occupying Junior Positions."

and inserting in their stead the words—

"Part IV. —Salaries payable to officers of the Second Division or Third Division.

Part V. —Salaries payable to officers of the Fourth Division.".

Definitions.

2. Regulation 3 of the Public, Service Regulations is amended—

(a) by omitting the definitions of "actual salary" and "standard salary"; and

(b) by omitting sub-regulation (2.).

Calculations of pay for duty on a holiday.

3. Regulation 63 of the Public Service Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (b) of sub-regulation (4.) the words " an actual salary that is the current equivalent of a standard salary of £812 per annum" and inserting in their stead the words "a salary of £1,142 per annum".

(b) by omitting from sub-paragraph (ii) of that paragraph the words "an actual salary that is the current equivalent of a standard salary of £707 per annum" and inserting in their stead the words "a salary of £988 per annum"; and

"(5.) The payment of an amount, or the granting of a period off duty, to a male officer whose salary exceeds £1,814 per annum or a female officer whose salary exceeds £1,660 per annum in consequence of his or her attendance and services during a holiday or half-holiday observed under section 76 of the Act shall be subject to the approval of the Board.".

Recording and payment of overtime.

4. Regulation 67 of the Public Service Regulations is amended—

(a) by omitting sub-regulation (6b.) and inserting in its stead the following sub-regulation :—

"(6b.) The minimum rate of overtime payment shall be Two shillings per hour and the maximum rate of overtime payment shall be ascertained by calculating—

(a) in the case of a male officer the rate payable to an officer in receipt of a salary of £1,142 per annum; and

(b) in the case of a female officer—the rate payable to an officer in receipt of a salary of £988 per annum.";

(b) by omitting sub-regulation (6d.) and inserting in its stead the following sub-regulation:

"(6d.) For the purposes of the last preceding sub-regulation, ' S ' is—

(a) in the case of a male officer—a salary of £1,814 per annum; or

(b) in the case of a female officer—a salary of £1,660 per annum."; and

"(a) in receipt of a salary at a rate exceeding—

(i) in the case of a male officer—£1,814 per annum; or

(ii) in the case of a female officer—£1,660 per annum; ".

Travelling time.

5. Regulation 69 of the Public Service Regulations is amended by omitting the words "of standard salary at a rate not exceeding £812 per annum or a female officer who is in receipt of a standard salary not exceeding £707 per annum" and inserting in their stead the words "of a salary at a rate exceeding £1,142 per annum or a female officer who is in receipt of a salary not exceeding £988 per annum".

Sunday duty.

6. Regulation 70 of the Public Service Regulations is amended—

(a) by omitting paragraph (d) of sub-regulation (5.) and inserting in its stead the following paragraph :

"(d) except with the approval of the Board, to an officer in receipt of a salary exceeding—

(i) in the case of a male officer—£1,814 per annum; or

(ii) in the case of a female officer—£1,660 per annum."; and

(b) by omitting sub-regulation (5a.) and inserting in its stead the following sub-regulation:—

" (5a.) For the purposes of this regulation, the maximum hourly rate shall be the rate calculated—

(a) in the case of a male officer on a salary of £1,142 per annum; and

(b) in the case of a female officer—on a salary of £988 per annum.".

Rates of travelling allowance

7.—(1.) Regulation 75a of the Public Service Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table:—

(2.) Regulation 75a of the Public Service Regulations is amended by omitting from sub-regulation (2.) the words "Two pounds seven shillings" and inserting in their stead the words " Two pounds fifteen shillings".

Allowances to officers performing relieving duties or working within defined districts.

8. Regulation 76 of the Public Service Regulations is amended by omitting the table in sub-regulation (1.) and inserting in its stead the following table :—

Fares.

9. Regulation 84 of the Public Service Regulations is amended by omitting the figures "£650" and inserting in their stead the figures "£928".

Higher duties.

10. Regulation 87 of the Public Service Regulations is amended—

(a) by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation :—

"(3.) Where an officer performs, for a period of less than a week, the duties of a higher office, being an office in respect of which the salary, or the maximum salary, payable to the occupant of the office exceeds—

(a) in the case of a male officer—£1,058 per annum ; or

(b) in the case of a female officer—£904 per annum, then, unless the Board in special circumstances otherwise determines, the officer shall not be paid an allowance for the performance of those duties for that period, and that period shall not be included in any period of service for the purposes of this regulation."; and

(b) by omitting sub-regulation (17.) and inserting in its stead the following sub-regulation :—

"(17.) Where an officer temporarily performs the duties of a higher office, being an office in respect of which the salary, or the maximum salary, including allowances in the nature of salary, payable to the occupant of the office is not less than—

(a) in the case of a male officer—£1,730 per annum ; or

(b) in the case of a female officer—£1,576 per annum, the preceding provisions of this regulation do not apply, but the officer may be paid in respect of the performance of those duties an allowance of such amount, and subject to such conditions, as the Board determines.".

Partial reimbursement of fares of certain officers.

11. Regulation 98aa of the Public Service Regulations is amended by omitting paragraph (b) of sub-regulation (1.) and inserting in its stead the following paragraph :—

"(b) is in receipt of a salary at a rate not exceeding £780 per annum; and".

Allowance— Sunday or holiday duty.

12. Regulation 99 of the Public Service Regulation is amended by omitting the words "of standard salary exceeding £1,244 per annum in the case of a male officer and £1,139 per annum in the case of a female officer" and inserting in their stead the words "of salary exceeding £1,814 per annum, in the case of a male officer and £1,660 per annum in the case of a female officer".

13. Parts IV., V., VI., VIa. and VIb. of the Public Service Regulations are repealed and the following Parts inserted in their stead :—

"Part IV.—Salaries payable to Officers of the Second Division or Third Division.

Salaries payable to officers of the Second or Third Division.

"104.—(.1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to a male officer who occupies an office in the Second

Division or the Third Division is, subject to this regulation, that rate or scale of rates specified in the table in this sub-regulation which is applicable to that office by virtue of its classification.

" (2.) Where a female office occupies an office in the Second Division or the Third Division in respect of which there is a rate of annual salary applicable to that office by virtue of its classification, the rate of annual salary payable to the female officer in respect of that office is £154 less than the rate so specified.

" (3.) Where a female officer occupies an office in the Second Division or the Third Division in respect of which there is applicable to that office by virtue of its classification a scale of rates specified in the table in sub-regulation (1.) of this regulation, the rates of annual salary payable to the female officer in respect of that office are each £1.54 less than the rates so specified.

" (4.) The rate of annual salary payable to a male officer who is of an ago specified in the first column of the table in this sub-regulation and occupies an office in the Third Division the minimum of the scale of rates of annual salary of which is less than £722 is the rate of annual salary specified in the second column of that table opposite to the age of the officer.

" (5.) The rate of annual salary payable to a female officer who is of an age specified in the first column of the table in this sub-regulation and occupies an office in the Third Division the minimum of the scale of rates of annual salary of which is less than £722 is the rate of annual salary specified in that table opposite to the age of the officer.

"(6.) " (8.) The minimum rate of annual salary payable to an officer appointed under section 36a of the Act, or appointed to an office in the Third Division who is a graduate of an Australian University or a University approved by the Board for the purpose of this sub-regulation, is—

(a) in the case of a male officer who has not attained the age of twenty-one years—£616;

(b) in the case of a female officer who has not attained the age of twenty-one years—£505 ;

(d) in the case of a female officer who has attained the age of twenty-one years—£694.

"(9.) The rate of annual salary or the scale of rates of annual salary payable to an officer of the Third Division who occupies an office of—

(a) Postal Clerk;

(b) Telegraphist;

(d) Senior Communications Officer, Grade 1;

(e) Senior Communications Officer, Grade 2; or

(f) Senior Communications Officer, Grade 3,

is the annual salary, or the scale of rates of annual salary, as the case may be, specified for that office in the First Schedule to these Regulations.

"(10.) The scale of rates of annual salary payable to an officer of the Department of Shipping and Transport who occupies an office in that Department, the designation of which is specified in the first column in the table in this sub-regulation is the scale of rates of annual salary specified in the second column of that table opposite to the designation.

Allowances in addition to salary.

"105.—(1.) An officer who is engaged, at such offices as the Board determines, on the regular exchange of duties with the Supervisor in charge of the evening staff for one day in three, or one week in three, shall, with the approval of the Chief Officer, be paid an allowance to increase his salary—

(a) if relieving a Supervisor (Telegraphs), Grade 1—to the minimum salary of a Supervisor (Telegraphs), Grade 1; or

(b)) if relieving a Supervisor (Telegraphs), Grade 1—to the salary of a Supervisor (Telegraphs), Grade 1, who has been granted one increment over the minimum salary of a Supervisor (Telegraphs), Grade 1.

"(2.) Where the officer next in seniority to the Postmaster or the Supervisor, as the case may be, at a, station to which this sub-regulation applies, is in receipt of salary, including any allowance payable under sub-regulation (5.) of this regulation, less than the equivalent of the maximum salary of the office; of Telegraphist in the Fourth Division plus an amount equal to the last increment payable within the scale of rates of annual salary of a Fourth Division Telegraphist, the Chief Officer may, upon satisfactory evidence of competency to attend to repeaters in the absence of the Postmaster or the Supervisor in charge, grant an allowance to that officer at the rate of £20 per annum.

"(3.) The stations to which the last preceding sub-regulation applies arc—

Mount Surprise, Queensland; Alice Springs, Northern Territory ; and Mullewa and Marble Bar, Western Australia.

"(4.) A telegraphist who has passed the examination for promotion to an office of Senior Telegraphist may, with the approval of the Chief Officer, be paid an allowance at the rate of £1.2 per annum until he is promoted to a higher office.

"(5.) A telegraphist in the Third Division upon passing an examination approved by the Board for the purpose of this sub-regulation shall be paid an allowance at the rate of £24 per annum in addition to the rate of salary payable to him under these Regulations.

Part V.—Salaries Payable to Officers of the Fourth Division.

Salaries of officers of the Fourth Division.

"106.— (1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to an officer of the Fourth Division who occupies an office specified in the second column of the First Schedule to these Regulations is, subject to this regulation, the rate of annual salary or the scale of rates of annual salary specified in the fifth column of that Schedule opposite to the designation of the office occupied by the officer.

"(2.) Where an annual rate of salary according to age is specified in the fifth column of the First Schedule to these Regulations opposite to the designation of an office specified in the second column of that Schedule, the annual salary payable to an officer who occupies such an office and is of an age specified in the fifth column of that Schedule is the rate specified in that column for that age.

"(3.) Where a female officer occupies an office specified in Part I. of the First Schedule to these Regulations, being an office opposite to the designation of which an annual rate of salary (not being an annual rate of salary according to age) is specified in the fifth column of that Schedule, the annual rate of salary payable to the female officer in respect of that office is £154 less than the rate so specified.

"(4.) Where a female officer occupies an office specified in Part I. of the First Schedule to these Regulations, being an office opposite to the designation of which a scale of rates of annual salary is specified in the fifth column of that Schedule, the rates payable to the female officer in respect of that office are, subject to sub-regulation (5.) of this regulation, each £154 less than the rates so specified.

"(5.) Where a female officer who is of an age specified in the second column of the table in this sub-regulation occupies an office, being an office specified in Part I. of the First Schedule to these Regulations, the designation of which is specified in the first column of that table, the annual rate of salary payable to the female officer is the rate specified in the third column of that table opposite to the age of the female officer.

" (7.) " (8.) Where a Department or a section of a Department is not specified in the third or fourth columns of the First Schedule to these Regulations opposite to the designation of an office, the rate of annual salary or the scale of rates of annual salary payable to an officer occupying an office of that designation in a Department or section of a Department is the rate or scale of rates specified in the fifth column of that Schedule opposite to that designation.

"(9.) Where—

(a) an officer occupies an office specified in the first column of the Second Schedule to these Regulations; or

(b) an employee is employed in an office specified in the first column of the Second Schedule to these Regulations, and the officer or employee has the qualifications, or complies with the conditions relating to an allowance, specified in the second column of that Schedule opposite to the designation of the office, he shall be paid an allowance at the rate specified in that column in respect of those qualifications or conditions.".

14. Regulation 109H of the Public Service Regulations is repealed and the following regulation inserted in its stead :—

Maximum salary for purposed of certain application.

109H. The maximum rate of salary for the purpose of sub-section (b) of section 50 of the Act is—

(a) in the case of a male officer a salary at the rate of £1,142 per annum; and

(b) in the case of a female officer—a salary at the rate of £988 per annum.".

The Schedules.

15. The First and Second Schedules to the Public Service Regulations are repealed and the following Schedules inserted in their stead:—

ALLOWANCES PAYABLE TO CERTAIN OFFICERS OF THE FOURTH DIVISION.

1	Assistant Warehouseman, Printing Branch, Department of the Treasury	1. He shall be paid an allowance at the rate of 15s. per week while in charge of two or more journeymen.
2	Boatman...............................	1. He shall be paid an allowance at the rate of £20 per annum if he holds a Master's Certificate, Rivers and Harbour.
		2. He shall be paid an allowance at the rate of £20 per annum if he holds an Engine-driver's Certificate.
3	Bookbinder, Printing Branch, Department of the Treasury	1. He shall be paid an allowance of 15s. per week while in charge of two or more journeymen.
4	Canteen Assistant.........................	1. He shall be paid an allowance at the rate of £20 per annum while employed as first assistant to the Canteen Manager, New South Wales or Victoria.
5	Compositor, Printing Branch, Department of the Treasury	1. He shall be paid an allowance at the rate of 15s. per week while in charge of two or more journeymen.
6	Excise Officer, Grade 2.....................	1. He shall be paid an allowance at the rate of £42 per annum, if—
		(a) he has completed twelve months' service to the satisfaction of the Chief Officer on the maximum salary of the office of Excise Officer, Grade 2 ; and
		(b) he occupied an office of Excise Officer or Excise Locker on the first day of August, 1941.
7	Fruit Inspector (Supervising)..................	1. He shall be paid an allowance of 15s. per week while supervising Fruit Inspectors (Supervising).
		2. He shall be paid an allowance of £75 per annum in lieu of overtime for all time worked in excess of 40 hours per week, including duty performed on Sundays and public holidays.
8	Line Etcher, Printing Branch, Department of the Treasury	1. He shall be paid an allowance at the rate of 15s. per week while in charge of two or more journeymen.

	Supervising Technician, Grade 7.........	(c) the Superintending Engineer has certified that the officer is required, in the performance of his duties, to send and receive messages by morse signals.
	Supervising Technician, Grade 8.........
		2. He may be paid an allowance at the rate of £20 per annum under such conditions as are, from time to time, approved by the Board, if—

		(a) he is employed on mail handling plant in the Mail Branch ; and
		(b) he has passed an examination in the subject of traffic procedure in operation in the Mail Branch.
22	Supervisor, Telephone Branch, Postmaster-General's Department	1. He may be paid an allowance at the rate of £20 per annum while in charge of a country telephone exchange.
23	Technician (Mail)......................	1. He may be paid an allowance at the rate of £20 per annum under such conditions as are, from time to time, determined by the Board, on passing an examination in the subject of traffic procedure in operation in the Mail Branch.
24	Technician's Assistant, Grade 2.............	1. He may be paid an allowance at the rate of £20 per annum if—
		(a) he is employed at—
		(i) a carrier repeater station ;
		(ii) a carrier terminal station ;
		(iii) a trunk line testing station ;

		(v) a chief telegraph office on telegraph maintenance duties ;

26	Accounting Machinist (Female), Grade 1	1. An officer whose salary is less than £574 per annum, and who passes, to the satisfaction of the Board, a test conducted by or on behalf of the Board for this purpose, shall be paid an allowance at the rate of £40 per annum.
27	Folder (Female), Printing Branch, Department of the Treasury	1. She shall be paid an allowance at the rate of £12 per annum if employed as a sewer.
		2. She shall be paid an allowance at the rate of 15s. per week while in charge of two or more Folders (Female).
		3. She shall be paid an allowance equal to the difference between her actual salary and the actual minimum salary payable from time to time to an adult who occupies an office of Folder (Female) if—
		(a) she has completed five years' service in an office of Folder (Female) ;
		(b) she has not attained the age of 21 years ; and
		(c) her salary is less than the actual minimum salary payable to an adult officer who occupies an office of Folder (Female).
28	Monitor (Female)........................	1. She may be paid an allowance at the rate of £20 per annum while in charge of a country telephone exchange.

She shall be paid an allowance at the rate of £12 per annum on evidence to the satisfaction of the Board of ability to accept by telephone, in fifteen minutes, ten typical telegrams, averaging an equivalent of six message units per telegram, and to record such telegrams by typewriter in the standard manner laid down by the Chief Officer.
30	Supervisor (Female), Telephone Branch, Postmaster-General's Department	1. She may be paid an allowance at the rate of £20 per annum while in charge of a country Telephone exchange.
31	Typist (Female), Grade 1 ....	1. An officer whose salary is less than £574 per annum, and who satisfies the Board as to her efficiency at writing shorthand at a rate of not less than 100 words per minute and correctly transcribing that shorthand shall be paid an allowance at the rate of £40 per annum.
		2. An officer shall be paid an allowance at the rate of £24 per annum if—
		(a) she has not satisfied the Board as to her efficiency at writing shorthand at the rate of not less than 100 words per minute ;
		(b) she has passed a test conducted by or on behalf of the Board in typing at the rate of 60 words per minute and in typing letters and documents with due regard to punctuation and form ; and
		(c) her rate of salary does not exceed £614 per annum.
		3. She shall be paid an allowance at such rate as is determined by the Board for any period during which she is employed on taking or transcribing notes of evidence in courts of law, or on duties which in the opinion of the Board are of like character.
32	Typist (Female), Grade 2.................	1. She shall be paid an allowance at such rate as is determined from time to time by the Board for any period during which she is employed on taking or transcribing notes of evidence in courts of law, or on duties which in the opinion of the Board are of like character.
