Overview
The Statutory Rules 1966, No. 130, was enacted to amend the Public Service Regulations under the Public Service Act 1922-1964. This regulation was introduced by the Public Service Board and approved by the Governor-General in order to revise certain salary rates for instructors within the Department of Civil Aviation and other departments. The policy objective of this legislative instrument was to ensure that remuneration for these roles is set in accordance with the prevailing standards and requirements of the public service sector. The regulation was made by the Public Service Board, acting on the authority conferred by the Public Service Act 1922-1964, and subsequently approved by the Governor-General in the exercise of their powers.
Scope and Application
The regulation, which amends the Public Service Regulations, applies to personnel within the Department of Civil Aviation and other departments who hold the positions of Instructor, Grade 1 and Instructor, Grade 2. This adjustment is part of a broader set of regulations under the Public Service Act 1922-1964, and thus pertains to all public service employees affected by the changes in remuneration outlined in Group 161. The regulation impacts the Commonwealth level, affecting the federal public service structure, including all departments that employ instructors at the specified grades. Notably, the amendment does not explicitly state exclusions or thresholds beyond the roles and departments mentioned, meaning the changes apply directly to those defined positions. The regulation may extend its application through further subordinate instruments, which would specify additional details or exceptions as required.
Key Provisions
This legislation amends the Public Service Regulations under the Public Service Act 1922-1964, specifically modifying the salary scales for certain grades of instructors within the Department of Civil Aviation and other departments. The regulation, which is made by the Public Service Board and approved by the Governor-General, introduces new salary brackets for 'Instructor, Grade 2' within the Department of Civil Aviation and for 'Instructor, Grade 1' and 'Instructor, Grade 2' in other departments. These changes are detailed in the First Schedule, where Group 161 has been replaced with updated salary figures (section 1(1)).
The obligations imposed by this regulation are primarily administrative, requiring the relevant departments to implement the new salary scales for the specified grades of instructors. This involves updating payroll systems and ensuring that all affected employees are compensated according to the new rates. There is no explicit requirement for departments to report back on the implementation of these changes, but the regulation's adoption implies a duty to comply with the stipulated salary adjustments.
There are no explicit offences, penalties, or civil/criminal consequences mentioned in this regulation for failure to comply with the new salary scales. However, non-compliance could potentially lead to grievances or legal actions by affected employees if they are not paid according to the new rates. The regulation itself does not specify any penalties, implying that any breaches would be subject to the general legal and administrative consequences applicable under the Public Service Act 1922-1964 and related employment laws.
