Overview
Statutory Rules 1968 No. 130, made under the Public Service Act 1922-1968, were enacted to amend the Public Service Regulations. These regulations were introduced to address specific issues within the administration of allowances and salary increments for officers and employees within the public service. The enacting body responsible for these regulations was the Public Service Board, with subsequent approval by the Governor-General. The overarching policy objective was to streamline and clarify the conditions under which education allowances are payable, particularly in relation to the age at which these allowances cease. The regulations also sought to refine the rates and conditions of Woomera allowance and the increments of salary, thereby ensuring more precise and effective administration of these benefits within the public service framework.
Scope and Application
The Statutory Rules 1968 No. 130, made under the Public Service Act 1922-1968, detail amendments to the Public Service Regulations. These regulations govern various allowances and conditions applicable to officers and employees of the Commonwealth public service. Specifically, they modify the education allowance for officers stationed at lighthouses, ensuring that the allowance ceases upon the child's eighteenth birthday but allows for continued payment during the ongoing school year if the birthday falls within that period. Additionally, the rules adjust the rates and conditions of the Woomera allowance and remove certain provisions regarding salary increments. These amendments are applicable to Commonwealth public servants and are subject to the approval of the Governor-General, as per the Public Service Act 1922-1968. The regulations are part of the Commonwealth's legislative framework and affect the terms and conditions of employment for public service officers within the Australian jurisdiction.
Key Provisions
The main operative sections of these Regulations concern amendments to specific provisions under the Public Service Regulations. Regulation 95c, which deals with the education allowance for children of officers and employees stationed at lighthouses, is amended to remove the age restriction of six to seventeen years and to extend the allowance if the child turns eighteen during a school year (Regulation 1(a) and (b)). Regulation 103a, concerning the rates and conditions of the Woomera allowance, is amended by removing certain sub-regulations and references (Regulation 2(a), (b), and (c)). Finally, Regulation 114, which pertains to increments of salary, is revised by removing specific sub-regulations (Regulation 3).
These amendments impose certain obligations and requirements on officers and employees eligible for these allowances. For instance, the education allowance now applies until the child turns eighteen, unless they are still attending school beyond this age. The Woomera allowance’s rates and conditions are subject to the specified changes, which may affect how these allowances are calculated or administered. The removal of certain sub-regulations in the salary increments section may streamline the process or criteria for receiving these increments.
In terms of consequences, while the Regulations themselves do not explicitly state penalties for non-compliance, breaches of the Public Service Act 1922-1968, under which these Regulations operate, could lead to various civil or criminal consequences. Depending on the nature and severity of the breach, penalties might include fines or other sanctions as prescribed by the Act or relevant laws. The exact penalties would depend on the specific provisions of the Public Service Act and any additional legislation pertaining to public service regulations.
