Overview
The Statutory Rules 1980 No. 3641, Public Service Regulations 1935 (Amendment), enacted in 1980, was introduced to amend the Public Service Regulations 1935. The primary purpose of this legislative instrument was to update the allowances for the use of private vehicles for official purposes within the public service. This amendment was made by the Public Service Board, exercising its authority under the Public Service Act 1922. The regulation was approved by the Governor-General, Zelman Cowen, on 4 December 1980, following advice from the Federal Executive Council. The specific changes included updating the rates in the table of sub-regulation (4) to reflect current allowances, thereby ensuring that the compensation for public servants using their private vehicles for official duties remains fair and commensurate with current economic conditions.
Scope and Application
The Public Service Regulations 1980, as amended, apply to all employees within the Commonwealth Public Service, including those in the Australian Public Service and other public service bodies established under the Public Service Act 1922. These regulations govern various aspects of employment within the public service, including allowances, conditions of service, and disciplinary procedures. They are designed to ensure consistency and fairness in the treatment of public servants across the Commonwealth. The regulations have a national reach, applying uniformly across all states and territories within Australia. However, specific allowances and conditions may vary based on the type of employment and the particular public service body involved. Notably, these regulations do not extend to private sector employees or those in state or territory public services, which are governed by their respective laws. The Public Service Board, under the authority of the Public Service Act, retains the power to make further amendments through subordinate instruments, ensuring that the regulations can be updated to reflect changing circumstances and requirements in the public service sector.
Key Provisions
The Public Service Regulations 1980 No. 3641, as amended, include provisions regarding allowances for the use of private vehicles for official purposes. Regulation 90 has been updated to adjust the rates of these allowances, substituting new figures in Column 4 of the relevant table. These updated rates are 20.3, 17.7, 16.0, and 14.3, replacing the previous figures of 18.1, 15.5, 14.4, and 13.3 respectively. This amendment ensures that the allowances provided for the use of private vehicles for official purposes reflect current standards and conditions.
Entities and individuals subject to these regulations, particularly public service employees who use their private vehicles for official duties, must adhere to the updated allowance rates. This includes accurately reporting the use of their vehicles and claiming the appropriate allowance in line with the revised rates. The Public Service Board, which exercises authority under the Public Service Act 1922, oversees compliance with these regulations.
Failure to comply with the updated allowance rates or misreporting vehicle usage for official purposes could result in civil or criminal consequences. The specific penalties for such breaches are not detailed in the provided text but generally, such violations could lead to financial penalties, legal action, or other disciplinary measures as outlined in the Public Service Act 1922 and related regulations. The precise nature and extent of penalties would depend on the severity of the breach and applicable laws.
