EXPLANATORY STATEMENT
STATUTORY RULES 1982 NO 61
PUBLIC SERVICE REGULATIONS (AMENDMENT)
Issued with the Authority of the Public Service Board
Sub-section 82(2) of the Public Service Act 1922 provides for the Public Service Board to select, in such manner as is prescribed, from the register of applicants for temporary employment such persons who are available as appear to be best qualified for the work.
Sub-section 97(1) of the Public Service Act 1922 provides in part:
‘(1) The Board may, with the approval of the Governor-General, make regulations ….
(1) for prescribing the form of register of applicants for temporary employment, and the mode in which it shall be kept, and the mode of selecting persons therefrom …’
The statutory rules replace former Public Service regulations 121 to 136A dealing with temporary employment.
New regulation 121 provides definitions of ‘applicant’ and ‘register’.
New regulation 122 provides that the register shall consist of applications for temporary employment made in such form as the Board from time to time directs and that it shall consist of such parts and be kept at such places as are determined by the Board.
New regulation 123 provides that in selecting persons for temporary employment the Board shall consider a number of factors concerning the temporary employment and the applicant. The regulation provides for preference to be given to ex-servicemen in cases when 2 or more applicants are otherwise equally suited for temporary employment.
New regulation 124 provides for the removal of applications from the register in certain circumstances.
New regulation 125 relates to the general obligations of employees and is identical to repealed regulation 136A.
These amendments follow a comprehensive review by the Board of the processes by which temporary employees are selected. They retain the essential elements to protect the impartiality and integrity of arrangements for the recruitment of temporary staff and provide a more appropriate basis for the selection of such staff in current circumstances.
Overview
The Public Service Regulations (Amendment) 2004, issued under the authority of the Public Service Board, represents an amendment to the Public Service Act 1922, which governs the recruitment and employment of public service personnel in Australia. This amendment specifically targets the regulation of temporary employment within the public service. The policy objective of these regulations is to ensure that the selection process for temporary staff remains impartial and upholds the integrity of the recruitment process, while also adapting to contemporary circumstances and providing a more suitable basis for the selection of temporary employees. This initiative was a response to a comprehensive review conducted by the Board, aiming to refine the mechanisms for selecting temporary employees while maintaining essential safeguards to protect the fairness and transparency of the recruitment process.
The Public Service Board, acting under the authority conferred by the Public Service Act 1922, introduced these statutory rules to replace the former Public Service regulations 121 to 136A. These new regulations define key terms, establish the format and management of the register of applicants for temporary employment, and outline the criteria for selecting candidates, including giving preference to ex-servicemen in cases of equal suitability. Additionally, the regulations address the conditions under which applications may be removed from the register and reiterate the general obligations of employees. The overarching goal is to ensure that the recruitment process for temporary positions within the public service remains equitable and suitable for current needs.
Scope and Application
The Public Service Regulations (Amendment) Statutory Rules 1982 No 61, issued under the authority of the Public Service Board, pertain to the selection, management, and administration of applicants for temporary employment within the public service framework. These regulations amend and replace the former regulations 121 to 136A, focusing on ensuring a fair, transparent, and efficient process for selecting temporary employees. The Board, under the powers granted by the Public Service Act 1922, has the authority to make these regulations to establish the form, maintenance, and management of the register of applicants, as well as the criteria and processes for selecting applicants for temporary positions. These regulations apply to all public service boards and temporary employees within the Commonwealth jurisdiction. Notably, the regulations provide for preference to be given to ex-servicemen when multiple applicants are equally qualified, reflecting a commitment to recognising and supporting the contributions of veterans in the workforce. The Board's discretion in defining the register's form and the selection criteria allows for flexibility in adapting to the evolving needs of the public service while maintaining the integrity and impartiality of the recruitment process.
Key Provisions
The main operative sections of these regulations (121 to 136A) establish the framework for the selection and management of applicants for temporary employment within the public service. Regulation 121 (1) provides definitions for key terms such as ‘applicant’ and ‘register’, which are foundational for the rest of the regulations. Regulation 122 (2) details the composition and maintenance of the register, specifying that it must be in the form directed by the Board and maintained in locations as determined by the Board. Regulation 123 (3) outlines the criteria for selecting applicants, including the consideration of various factors and the preferential treatment of ex-servicemen when multiple applicants are equally qualified. Regulation 124 (4) sets out the conditions under which applications can be removed from the register, ensuring the register remains current and relevant. Finally, Regulation 125 (5) reiterates the general obligations of employees, ensuring continuity from previous regulations.
The obligations imposed by these regulations primarily concern the Public Service Board. The Board is tasked with maintaining the register of applicants, ensuring it is in the correct form and stored appropriately, as specified in Regulation 122 (2). When selecting candidates for temporary employment, the Board must consider multiple factors, giving preference to ex-servicemen when applicable, as outlined in Regulation 123 (3). The Board must also manage the removal of applications from the register under certain conditions, as detailed in Regulation 124 (4). These obligations are designed to uphold the integrity and impartiality of the selection process.
Breaches of these regulations may have specific consequences, although the explanatory statement does not detail specific offences or penalties. However, given the context of public service regulations, violations could potentially lead to administrative actions, disciplinary measures, or other consequences as determined by the Public Service Board or relevant authorities. While the statement does not specify maximum penalties, it is likely that any breaches could result in corrective actions aimed at maintaining the standards and integrity of the public service employment processes.
