EXPLANATORY STATEMENT
STATUTORY RULES 1987 No. 270
PUBLIC SERVICE REGULATIONS (AMENDMENT)
Issued with the authority of the Public Service Commission
Subsection 97 (1) of the Public Service Act 1922 (‘the Act’) provides, inter alia, that the Governor-General may make regulations, not inconsistent with the Act, prescribing matters required or permitted by the Act to be prescribed, or necessary or convenient to be prescribed for carrying out or giving effect to the Act.
The statutory rules amend Public Service Regulations 72B to 72K which provide for the constitution, powers and functions of Joint Council. The amendments are required because the administration of Joint Council has now become the responsibility of the Department of Industrial Relations.
The statutory rules amend Public Service Regulations 72B to 72K in the following ways:
• references to the Public Service Board become references to the Secretary to the Department of Industrial Relations;
• references to a representative of the Public Service Board become references to a representative of the Department of Industrial Relations;
• the provision constituting Joint Council (regulation 72B) provides for a representative of the Public Service Commissioner nominated by the Public Service Commissioner. As a consequence of the above, the number of departmental representatives is reduced by one;
• consequential changes are made to the quorum provision (subregulation 72D (2));
• references to Chairman and Deputy Chairman are replaced by references which are not gender specific.
The amendments form part of the implementation of the successor arrangements to the Public Service Board announced by the Prime Minister on 14 July 1987.
