REGULATIONS UNDER THE PUBLIC SERVICE ACT 1922-1958.*

THE PUBLIC SERVICE BOARD, acting in pursuance and exercise of the authority conferred upon it by the Public Service Act 1922-1958, hereby makes, subject to the approval of the Governor-General, the following Regulations.

Amendments of the Public Service Regulations.†

Calculation of pay for duty on a holiday.

1. Regulation 63 of the Public Service Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (b) of sub-regulation (4.) the figures “£1,173” and inserting in their stead the figures “£1,298”;

Recording and payment of overtime.

2. Regulation 67 of the Public Service Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (6b.) the figures “£1,173” and inserting in their stead the figures “£1,298”;

(b) by omitting from paragraph (b) of sub-regulation (6b.) the figures “£1,019” and inserting in their stead the figures “£1,144”;

(c) by omitting from paragraph (a) of sub-regulation (6d.) the figures “£1,943” and inserting in their stead the figures “£2,228”;

(d) by omitting from paragraph (b) of sub-regulation (6d.) the figures “£1,789” and inserting in their stead the figures “£2,074”;

(e) by omitting from sub-paragraph (i) of paragraph (a) of sub-regulation (13.) the figures “£1,943” and inserting in their stead the figures “£2,228”; and

Travelling time.

3. Regulation 69 of the Public Service Regulations is amended by omitting the figures “£1,173” and “£1,019” and inserting in their stead the figures “£1,298” and “£1,144”, respectively.

Sunday duty.

4. Regulation 70 of the Public Service Regulations is amended—

(a) by omitting from sub-paragraph (i) of paragraph (d) of sub-regulation (5.) the figures “£1,943” and inserting in their stead the figures “£2,228”;

(b) by omitting from sub-paragraph (ii) of that paragraph the figures “£1,789” and inserting in their stead the figures “£2,074”;

(c) by omitting from paragraph (a) of sub-regulation (5a.) the figures “£1,173” and inserting in their stead the figures “£1,298”; and

(d) by omitting from paragraph (b) of that sub-regulation the figures “£1,019” and inserting in their stead the figures “£1,144”.

Rates of travelling allowances.

5. Regulation 75a. of the Public Service Regulations is amended by omitting the table in sub-section (1.) and inserting in its stead the following table:—

Fares.

6. Regulation 84 of the Public Service Regulations is amended by omitting the figures “£938” and inserting in their stead the figures “£1,028”.

Higher duties.

7. Regulation 87 of the Public Service Regulations is amended—

(a) by omitting from paragraph (a) of sub-regulation (3.) the figures “£1,083” and inserting in their stead the figures “£1,188”;

(b) by omitting from paragraph (b) of that sub-regulation the figures “£929” and inserting in their stead the figures “£1,034”;

(c) by omitting from paragraph (a) of sub-regulation (17.) the figures “£1,833” and inserting in their stead the figures “£2,098”; and

(d) by omitting from paragraph (b) of that sub-regulation the figures “£1,679” and inserting in their stead the figures “£1,944”.

Partial reimbursement of fares of certain officers.

8. Regulation 98aa of the Public Service Regulations is amended by omitting from paragraph (b) of sub-regulation (1.) the figures “£749” and inserting in their stead the figures “£814”.

Allowance—Sunday or holiday duty.

9. Regulation 99 of the Public Service Regulations is amended by omitting the figures “£1,943” and “£1,789” and inserting in their stead the figures “£2,228” and “£2,074”, respectively.

10.—(1.) Parts IV. and V. of the Public Service Regulations are repealed and the following Parts inserted in their stead:—

“Part IV.—Salaries Payable to Officers of the Second Division or Third Division.

Salaries payable to officers of the Second or Third Division.

“104.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to a male officer who occupies an office in the Second Division or the Third Division is, subject to this regulation, that rate or scale of rates specified in Table A or Table B in this sub-regulation which is appropriate to that office having regard to its classification.

“(2.) Where a female officer occupies an office in the Second Division or the Third Division in respect of which there is a rate of annual salary applicable to that office by reason of the last preceding sub-regulation, the rate of annual salary payable to the female officer in respect of that office is £154 less than that rate.

“(3.) Where a female officer occupies an office in the Second Division or the Third Division in respect of which there is applicable to that office by reason of sub-regulation (1.) of this regulation a scale of rates specified in Table A or Table B in that sub-regulation, the rates of annual salary payable to the female in respect of that office are, subject to sub-regulation (5.) of this regulation, each £154 less than the rates so specified.

“(4.) The rate of annual salary payable to a male officer who is of an age specified in the first column of the table in this sub-regulation and occupies an office in the Third Division the minimum of the scale of rates of annual salary of which is less than £758 is the rate of annual salary specified in the second column of that table opposite to the age of the officer.

“(5.) “(6.) “(7.) “(8.) The minimum rate of annual salary payable to an officer appointed under section 36a of the Act, or appointed to an office in the Third Division who has qualified for admission to a degree at an Australian University or a University approved by the Board for the purpose of this sub-regulation, is—

(a) in the case of a male officer who has not attained the age of twenty-one years—£655;

(b) in the case of a female officer who has not attained the age of twenty-one years—£532;

(d) in the case of a female officer who has attained the age of twenty-one years—£759.

“(9.) The rate of annual salary or the scale of rates of annual salary payable to an officer of the Third Division who occupies an office of—

(a) Assistant Chief Drafting Officer;

(b) Chief Drafting Officer;

(d) Drafting Assistant, Grade 1;

(e) Drafting Assistant, Grade 2;

(f) Drafting Officer, Grade 1;

(g) Drafting Officer, Grade 2;

(h) Postal Clerk;

(i) Senior Communications Officer, Grade 1;

(j) Senior Communications Officer, Grade 2;

(k) Senior Communications Officer, Grade 3;

(l) Senior Communications Officer, Grade 4;

(m) Senior Communications Officer, Grade 5;

(n) Senior Drafting Officer, Grade 1;

(o) Senior Drafting Officer, Grade 2;

is the annual salary, or the scale of rates of annual salary, as the case may be, that would be payable to the officer if the officer were an officer of the Fourth Division.

“(10.) The rate of annual salary or the scale of rates of annual salary payable to an officer of the Third Division who occupies an office the designation of which is specified in the first column of the table in this sub-regulation is—

(a) in the case of a male officer—the rate of annual salary specified in the second column in relation to the age of the officer or the scale of rates of annual salary specified in that column, as the case may be, opposite to the office that he occupies; and

(b) in the case of a female officer—the rate of annual salary specified in the third column in relation to the age of the officer or the scale of rates of annual salary specified in that column, as the case may be, opposite to the office that she occupies.

Allowances in addition to salary.

“105.—(1.) An officer who is engaged, at such offices as the Board determines, on the regular exchange of duties with the Supervisor in charge of the evening staff for one day in three, or one week in three, shall, with the approval of the Chief Officer, be paid an allowance to increase his salary—

(a) if relieving a Supervisor (Telegraphs), Grade 1—to the minimum salary of a Supervisor (Telegraphs), Grade 1; or

(b) if relieving a Supervisor (Telegraphs), Grade 2—to the salary of a Supervisor (Telegraphs), Grade 1, who has been granted one increment over the minimum salary of a Supervisor (Telegraphs), Grade 1.

“(2.) Where the officer next in seniority to the Postmaster or the Supervisor, as the case may be, at a station to which this sub-regulation applies, is in receipt of salary, including any allowance payable under sub-regulation (5.) of this regulation, less than the equivalent of the maximum salary of the office of Telegraphist in the Fourth Division plus an amount equal to the last increment payable within the scale of rates of annual salary of a Fourth Division Telegraphist, the Chief Officer may, upon satisfactory evidence of competency to attend to repeaters in the absence of the Postmaster or the Supervisor in charge, grant an allowance to that officer at the rate of £38 per annum.

“(3.) The stations to which the last preceding sub-regulation applies are—

Mount Surprise, Queensland; Alice Springs, Northern Territory; and Mullewa and Marble Bar, Western Australia.

“(4.) A telegraphist who has passed the examination for promotion to an office of Senior Telegraphist may, with the approval of the Chief Officer, be paid an allowance at the rate of £12 per annum until he is promoted to a higher office.

“(5.) A telegraphist in the Third Division upon passing an examination approved by the Board for the purpose of this sub-regulation shall be paid an allowance at the rate of £38 per annum in addition to the rate of salary payable to him under these Regulations.

“(6.) A telegraphist in the Third Division shall be paid an allowance at the rate of £38 per annum when rostered for picturegram duty.

“Part V.—Salaries Payable to Officers of the Fourth Division.

Salaries of officers of the Fourth Division.

“106.—(1.) For the purposes of sub-section (2.) of section 30 of the Act, the rate of annual salary or the scale of rates of annual salary payable to an officer of the Fourth Division who occupies an office the designation of which is specified in the second column of Part I. or Part II. of the First Schedule to these Regulations is, subject to this regulation, the rate of annual salary or the scale of rates of annual salary specified in the fifth column of that Part opposite to the designation of the office occupied by the officer.

“(2.) Where an annual rate of salary according to age is specified in the fifth column of Part I. or Part II. of the First Schedule to these Regulations opposite to the designation of an office specified in the second column of that Part, the annual salary payable to an officer who occupies such an office and is of an age specified in the fifth column of that Part is the rate specified in that column for that age.

“(3.) Where a female officer occupies an office the designation of which is specified in Part I. of the First Schedule to these Regulations, being an office opposite to the designation of which an annual rate of salary (not being an annual rate of salary according to age) is specified in the fifth column of that Part, the annual rate of salary payable to the female officer in respect of that office is £154 less than the rate so specified.

“(4.) Where a female officer occupies an office the designation of which is specified in Part I. of the First Schedule to these Regulations being an office opposite to the designation of which a scale of rates of annual salary is specified in the fifth column of that Part, the rates payable to the female officer in respect of that office are, subject to sub-regulation (5.) of this regulation, each £154 less than the rates so specified.

“(5.) Where a female officer who is of an age specified in the second column of the table in this sub-regulation occupies an office, being an office specified in Part I. of the First Schedule to these Regulations, the designation of which is specified in the first column of that table, the annual rate of salary payable to the female officer is the rate specified in the third column of that table opposite to the age of the female officer.

“(7.) The minimum rate of annual salary payable to an officer who occupies an office specified in the last preceding sub-regulation is the rate of annual salary specified in the second column of the table in this sub-regulation opposite to the age of the officer.

“(8.) Notwithstanding anything contained in the last preceding sub-regulation, the Board may determine that an officer who occupies an office specified in sub-regulation (6.) of the regulation shall be paid a rate of salary ascertained by reference to the period of service of the officer in accordance with the following table if the rate so ascertained would result in the payment of a higher rate of salary than that applicable under the last preceding sub-regulation.

“(9.) For the purpose of the last preceding sub-regulation, ‘service’ means—

(a) in the case of an officer occupying an office of Typist (Female) or Accounting Machinist (Female), Grade 1—proved experience, either within or without the Commonwealth Service, as a typist or accounting machinist or proved experience in both of those occupations; or

(b) in the case of an officer who occupies an office of Card Punch Operator (Female), Grade 1—proved experience, either within or without the Commonwealth Service, as a card punch operator, typist, or accounting machinist or proved experience in more than one of those occupations.

“(10.) The scale of rates of annual salary payable to an officer who occupies an office specified in the first column of the table in this sub-regulation is the scale of rates of annual salary specified in the second column of that table opposite to the designation of the office occupied by the officer.

“(11.) The rate of annual salary payable to an officer who occupies an office specified in the table in the last preceding sub-regulation and is of an age specified in the table in this sub-regulation is—

(b) in the case of an officer who occupies an office of Cycle Mechanic-in-training—the rate specified in the third column of the table in this sub-regulation opposite to the age of the officer; and

(c) in the case of an officer who occupies an office of Technician-in-training or Technician-in-training (Radio)—the rate specified in the fourth column of the table in this sub-regulation opposite to the age of the officer.

“(12.) Notwithstanding anything contained in the last preceding sub-regulation, the Board may determine that an officer who occupies an office specified in the table in sub-regulation (10.) of this regulation shall be paid a rate of salary ascertained by reference to the period of service of the officer in accordance with the following table if the rate so ascertained would result in a higher rate of salary than that applicable under the last preceding sub-regulation.

“(14.) Where a Department or section of a Department is not specified in the third or fourth column of Part I. or Part II. of the First Schedule to these Regulations opposite to a designation of an office, the rate of annual salary or the scale of rates of annual salary payable to an officer occupying an office of that designation in a Department or section of a Department is the rate or scale of rates specified in the fifth column of that Part opposite to that designation.

“(15.) Where—

(a) an officer occupies an office specified in the second column of the Second Schedule to these Regulations; or

(b) an employee is employed in an office specified in the second column of the Second Schedule to these Regulations,

and the officer or employee has the qualifications, or complies with the conditions relating to an allowance, specified in the third column of that Schedule opposite to the designation of the office, he shall be paid an allowance at the rate specified in that column in respect of those qualifications or conditions.

“(16.) In this regulation, a reference to the rate of salary or the scale of rates of salary payable to an officer who occupies an office in the Fourth Division is a reference to the rate of salary or the scale of rates of salary applicable to that office by virtue of its classification.".

(2.) The Board may authorize the payment of an allowance, in respect of the period that commenced on the third day of December, 1959, and ended on the day immediately before the commencement of these Regulations, to each officer and employee of such an amount as would result in the total remuneration of the officer or employee being not less than

the total remuneration that would have been payable to the officer or employee in respect of that period if the amendments made by these Regulations had taken effect on the third day of December, 1959.

11. Regulation 106a of the Public Service Regulations is amended by omitting from the table in sub-regulation (4.) the figures “£532” and inserting in their stead the figures “£555”.

12. Regulation 109b of the Public Service Regulations is amended by inserting after sub-regulation (4.) the following sub-regulation:—

“(5.) Where the Board has, by notice published in the Gazette under sub-section (4.) or sub-section (5.) of section 29 of the Act, directed that sub-section (3.) of that section shall not apply to an alteration in the classification of an office, being an alteration that raises the classification of that office, the officer who occupies the office on the day on which the alteration is made shall, for the purposes of this regulation, be deemed to have been promoted to a higher office having the raised classification.”.

Maximum salary for purposes of certain appeals.

13. Regulation 109h of the Public Service Regulations is amended—

(a) by omitting from paragraph (a) the figures “£1,263” and inserting in their stead the figures “£1,408”; and

(b) by omitting from paragraph (b) the figures “£1,109” and inserting in their stead the figures “£1,254”.

Conditions of transfer from Fourth Division to Third Division.

14. Regulation 112 of the Public Service Regulations is amended by omitting from sub-regulation (2.) the figures “£369” and “£903” and inserting in their stead the figures “£385” and “£968”, respectively.

Temporary transfer.

15. Regulation 116 of the Public Service Regulations is amended by omitting from sub-section (1c.) the figures “£2,053” and inserting in their stead the figures “£2,358”.

16. The First and Second Schedules to the Public Service Regulations are repealed and the following Schedules are inserted in their stead:—

ALLOWANCES PAYABLE TO CERTAIN OFFICERS OF THE FOURTH DIVISION.

1	Boatman..........................	1. He shall be paid an allowance at the rate of £26 per annum if he holds a Master’s Certificate, Rivers and Harbour.

2	Bookbinder, Printing Branch, Department of the Treasury	1. He shall be paid an allowance of 19s. per week while in charge of two or more journeymen.
3	Canteen Assistant....................	1. He shall be paid an allowance at the rate of £51 per annum while employed as first assistant to the Canteen Manager, New South Wales or Victoria.
4	Compositor, Printing Branch, Department of the Treasury	1. He shall be paid an allowance of 19s. per week while in charge of two or more journeymen.
5	Electrical Fitter and Mechanic............	1. He shall be paid an allowance at the rate of £38 per annum under such conditions as are, from time to time, determined by the Board, if—
		(a) he has passed an examination in the subject of traffic procedure in operation in the Mail Branch; and
		(b) he is employed on the maintenance of mail handling plant in the Mail Branch.
6	Excise Officer, Grade 2................	1. He shall be paid an allowance at the rate of £55 per annum, if—
		(a) he has completed twelve months’ service to the satisfaction of the Chief Officer on the maximum salary of the office of Excise Officer, Grade 2; and
		(b) he occupied an office of Excise Officer or Excise Locker on the first day of August, 1941.
7	Fruit Inspector (Supervising).............	1. He shall be paid an allowance of £1 8s. 6d. per week while supervising Fruit Inspectors (Supervising).
7	Fruit Inspector (Supervising).............	2. He shall be paid an allowance of £114 per annum in lieu of overtime for all time worked in excess of 40 hours per week, including duty performed on Sundays and public holidays.
8	Line Etcher, Printing Branch, Department of the Treasury	1. He shall be paid an allowance at the rate of 19s. per week while in charge of two or more journeymen.
9	Linotype Operator, Printing Branch, Department of the Treasury	1. He shall be paid an allowance at the rate of 19s. per week while in charge of two or more journeymen.

		(b) the Chief Officer has certified that the officer is required, in the performance of his duties, to send and receive messages by morse signals.
11	Machinist, Printing Branch, Department of the Treasury	1. He shall be paid an allowance at the rate of 19s. per week while in charge of two or more journeymen.
12	Mail Officer........................	1. He shall be paid an allowance at the rate of £51 per annum if—
		(a) he has passed the test determined by the Board for the purpose; and

		2. The allowance under this item shall cease to be payable on the day immediately prior to the date on which the officer attains the age of 21 years.
16	Postal Officer.......................	1. He shall, whilst employed in the city section at Sydney, Melbourne, Brisbane, Adelaide or Perth, be paid, under such conditions as are, from time to time, approved by the Board, an allowance equal to the difference between his salary and the salary which would be payable to him from time to time if the scale of rates of annual salary of the office was £696–£722–£747–£773–£798–£824–£849.
17	Quarantine Assistant, Grade 1............	1. He shall be paid an allowance at the rate of £26 per annum if he holds a Master’s Certificate, Rivers and Harbour.
	Quarantine Assistant, Grade 2............	2. He shall be paid an allowance at the rate of £26 per annum if he holds an Engine-driver's Certificate and is regularly employed on launches.

32	Folder (Female), Printing Branch, Department of the Treasury	1. She shall be paid an allowance at the rate of £13 per annum if employed as a sewer.
		2. She shall be paid an allowance at the rate of 19s. per week while in charge of two or more Folders (Female).
		3. She shall be paid an allowance equal to the difference between her actual salary and the actual minimum salary payable from time to time to an adult who occupies an office of Folder (Female) if—
