Overview
The Statutory Rules 1967 No. 1, enacted under the Public Service Act 1922-1966, amends the Public Service Regulations to adjust the salaries payable to officers of the Second Division. The Public Service Board made this regulation, subject to the approval of the Governor-General, to address the need for updated salary classifications within the public service. This legislative instrument was introduced to ensure that remuneration for public service officers remains competitive and reflective of their roles and responsibilities. The regulation was approved by the Governor-General, acting on the advice of the Federal Executive Council, and aims to provide a fair and structured approach to the remuneration of public service officers.
Scope and Application
The Statutory Rules 1967 No. 1, made under the Public Service Act 1922-1966, amends the Public Service Regulations, specifically addressing the salaries payable to officers of the Second Division. This legislative instrument applies to male officers occupying offices within the Second Division of the Australian Public Service, thereby affecting their remuneration. The regulation sets new rates of annual salary for these positions, ranging from $9,500 to $14,500, depending on the classification of the office. The amendment is applicable nationally, affecting officers across the Commonwealth of Australia. The regulation operates within the legislative framework provided by the Public Service Act 1922-1966 and is subject to approval by the Governor-General, as well as the advice of the Federal Executive Council. No specific exclusions or exemptions are stated within the text, and the scope of the amendment is confined to the amendment of the specified regulation without broader jurisdictional or industry-specific limitations. The application of the regulation is direct and does not extend or restrict through subordinate instruments, focusing solely on the adjustment of salary rates for the designated officers.
Key Provisions
The main operative sections of the regulation, particularly Regulation 104, pertain to the amendment of the Public Service Regulations, specifically altering the rates of annual salary payable to male officers in the Second Division of the Public Service. The regulation specifies that the rate of annual salary should now be one of the following: $9,500, $10,500, $11,500, $12,500, $13,500, or $14,500, depending on the classification of the office they occupy, as per section 30(2) of the Public Service Act 1922-1966. This alteration is intended to reflect updated remuneration standards for these positions.
The Act imposes obligations on the Public Service Board to ensure that the salaries of male officers in the Second Division are aligned with the specified rates. The Board must review and determine the appropriate salary based on the classification of the office, thereby ensuring that remuneration is fair and commensurate with the duties and responsibilities of each position. Additionally, the Act mandates that these amendments be communicated and implemented effectively across the relevant divisions of the Public Service.
In terms of compliance and enforcement, breaches of the regulations regarding the payment of salaries could lead to civil or administrative consequences. While the regulation does not explicitly detail the penalties for non-compliance, it is understood that failure to adhere to the prescribed salary rates could result in legal action or administrative penalties. The maximum penalties, however, are not specified within the text of the regulation itself but may be outlined in other relevant sections of the Public Service Act or associated legislative instruments.
Overall, the regulation aims to standardise and update the salary structure for male officers in the Second Division, ensuring that their remuneration aligns with the classification of their roles. The Public Service Board is tasked with the responsibility of implementing these changes and ensuring compliance with the specified salary rates.
