Overview

The Public Service Regulations 1964 were enacted to amend the existing Public Service Regulations under the Public Service Act 1922-1964. The Public Service Board, acting with the authority conferred by the Public Service Act, made these regulations, subject to the approval of the Governor-General. These amendments aimed to adjust the salaries and allowances of various officers within the Fourth Division of the Public Service, including apprentices, cycle mechanics-in-training, and technicians-in-training, both generally and specifically for radio technicians. Additionally, the regulations introduced new categories such as steno-secretaries and boatmen, along with their respective remuneration structures. The policy objective behind these amendments was to ensure that the remuneration of public service officers was fair, competitive, and reflective of their skills, experience, and performance, thereby maintaining the efficiency and effectiveness of the public service. The enacting body was the Public Service Board, which proposed these regulations under the authority of the Public Service Act. Subsequently, the Governor-General approved these regulations, formalising them as statutory rules. These regulations were designed to address the need for updated salary scales and allowances for various roles within the public service, ensuring that compensation structures were aligned with the changing demands and responsibilities of these positions.

Scope and Application

The Regulations under the Public Service Act 1922-1964, as approved by the Governor-General, apply to officers within the Commonwealth public service, specifically targeting those in the Fourth Division of the public service. This includes various apprentices and trainees such as Apprentices, Cycle Mechanic-in-training, Technician-in-training, and Technician-in-training (Radio). The geographic reach of these regulations is limited to the Commonwealth level, thus affecting public servants employed by the federal government. The regulations do not specify any exclusions or exemptions, but they do detail amendments to salary scales and allowances based on performance and length of service. These regulations extend the application of the Act through detailed amendments to the Public Service Regulations, particularly affecting remuneration and allowances for the specified positions.

Key Provisions

The main operative sections of these Regulations under the Public Service Act 1922-1964 primarily focus on amending the Public Service Regulations, particularly concerning the salaries and allowances for officers in the Fourth Division. Regulation 1 amends Regulation 106 by updating the figures for annual salaries for Apprentices, Cycle Mechanics-in-training, and Technicians-in-training, including those specializing in Radio. Additionally, it modifies the salary scales based on the age and period of service of these officers (Reg. 1(2)–(4)). Regulation 2 updates the rates of salary increases for officers within the Fourth Division (Reg. 2). The First Schedule introduces new designations for Steno-secretaries (Female) with specific salary scales (Reg. 3). These Regulations impose several obligations and requirements on the parties and entities governed by them. Firstly, officers in the Fourth Division, including Apprentices, Cycle Mechanics-in-training, Technicians-in-training, and Technicians-in-training (Radio), must meet certain academic performance criteria to be eligible for additional allowances. For instance, Apprentices and Cycle Mechanics-in-training must pass all subjects in their yearly examinations to receive an allowance, while Technicians-in-training and Technicians-in-training (Radio) must achieve at least 75% in each subject (Reg. 4(1)–(2)). Furthermore, these Regulations require that any officer or employee who was employed in these roles between 31 October 1963 and the commencement of these Regulations be compensated retroactively to reflect the new salary scales (Reg. 5). Failure to comply with these Regulations may lead to civil consequences, although specific offences and penalties are not explicitly detailed within the text. Given the nature of the amendments, non-compliance could potentially result in disputes over remuneration or eligibility for allowances. However, it is important to note that while the Regulations provide detailed salary scales and allowances, they do not explicitly outline penalties for breach. Instead, any breaches might be addressed through the general provisions of the Public Service Act 1922-1964 or other relevant legislation, which could include disciplinary actions or legal recourse for affected parties.
