Overview

The Statutory Rules 1976 No. 229, titled "Regulation Under the Public Service Act 1922," was enacted to amend the Public Service Regulations, specifically addressing the allowance in respect of high electricity charges in remote districts. The Public Service Board, acting under the authority of the Public Service Act 1922, created this regulation, which was subsequently approved by the Governor-General. The regulation introduces a revised table outlining the officer's contributions based on the units of electricity used during various charging periods—quarterly, two-monthly, and monthly. The intent behind this regulation appears to be to provide a structured approach to managing and potentially mitigating the high costs of electricity in remote areas for public service officers. The regulation was enacted to ensure that the financial burden on public service officers living in remote areas, where electricity costs can be significantly higher, is more equitably managed. By setting specific contribution rates based on usage, the regulation aims to offer a fair and predictable allowance system, thereby supporting the officers in these challenging circumstances.

Scope and Application

The Statutory Rules 1976 No. 229, made under the Public Service Act 1922, amend the Public Service Regulations to revise the allowance for high electricity charges in remote districts. This regulation applies to officers within the public service who incur high electricity charges, specifically those working in remote areas. The amendment affects the contribution rates for electricity charges based on different charging periods—quarterly, two-monthly, and monthly. The new rates are detailed in a table provided in the regulation, reflecting the amount officers are required to contribute depending on the units of electricity used within these periods. The regulation aims to ensure that officers in remote areas are appropriately compensated for their higher electricity costs, thereby maintaining fair treatment and support for public servants in challenging conditions. The regulation does not explicitly state any exclusions or thresholds, but its application is inherently limited to public service officers affected by high electricity charges in remote districts. The scope of this amendment is limited to the specified charging periods and does not extend beyond the parameters outlined in the amended regulation.

Key Provisions

The principal amendment in this Statutory Rule (2004L01530) pertains to Regulation 97c of the Public Service Regulations, which involves allowances for high electricity charges in remote districts (Regulation 97c(4)). This regulation specifies the contribution an officer must make based on the amount of electricity consumed over a set period: quarterly, two-monthly, or monthly. The new regulation replaces the previous sub-regulation (4) with a detailed table outlining the contribution amounts based on the units of electricity used during the specified period. The amended regulation imposes obligations on officers to ensure they contribute the correct amount as per the table provided. These contributions are based on the consumption of electricity and vary according to whether the billing period is quarterly, two-monthly, or monthly. For instance, for a quarterly period, an officer using below 480 units of electricity must contribute $22.50, while an officer using between 1050 and 1079 units must contribute $52.50. Similar gradations are specified for two-monthly and monthly billing periods. Failure to comply with the new provisions may lead to discrepancies in the calculation of the officer’s contribution, potentially resulting in financial inaccuracies. However, the Statutory Rule does not explicitly mention any specific penalties or consequences for non-compliance. Generally, non-compliance with public service regulations could result in administrative actions or other penalties as determined by relevant authorities under the Public Service Act 1922. These could include disciplinary measures or financial redress, depending on the severity and impact of the non-compliance.
