Overview

The Statutory Rules 1963 No. 153, enacted under the Public Service Act 1922-1960, were introduced by the Public Service Board and subsequently approved by the Governor-General to address the need for amendments to the Public Service Regulations. This legislative instrument updates the salary scales for officers in the Second and Third Divisions, and introduces new salary scales for academic staff at institutions such as the Australian Forestry School and the Royal Military College. The policy objective appears to be ensuring fair and equitable remuneration within the public service, reflecting the changing economic conditions and the need to attract and retain skilled personnel. The regulations also address gender disparities by reducing the salaries of female officers in certain divisions, a practice that was presumably common at the time but has since been rectified through subsequent legislative and policy changes.

Scope and Application

The Regulations under the Public Service Act 1922-1960 are applicable to officers of the Commonwealth Public Service, specifically those within the Second and Third Divisions, and to academic staff at institutions such as the Australian Forestry School, R.A.A.F. Academy, and Royal Military College. These regulations govern aspects such as salaries and allowances for these public service officers and academic staff. The regulations have a national reach as they apply across the Commonwealth of Australia, administered by the Public Service Board and approved by the Governor-General. The regulations include specific amendments to salary scales, notably reducing the annual salary rates for female officers in the Second and Third Divisions by £154. Furthermore, the Fourth Schedule is amended to include detailed salary scales for various academic positions within specified institutions. These regulations do not explicitly state exclusions or thresholds but operate under the broader framework of the Public Service Act and its subsidiary instruments.

Key Provisions

The Public Service Regulations, 1963, under the Public Service Act 1922-1960, include several key provisions primarily focused on amending salary scales for officers in the Second and Third Divisions of the Public Service. Regulation 104 is amended to adjust the salary scales, inserting new tables in place of the existing ones. This change affects the annual salary rates for these officers. Additionally, sub-regulation (4) of Regulation 104 is modified to specify that female officers in the Second and Third Divisions will receive salaries that are £154 less than the rates applicable to male officers in the same positions, subject to certain conditions. Furthermore, the Fourth Schedule is amended to include a new Part X, which sets out the salary scales for academic staff at institutions such as the Australian Forestry School, the R.A.A.F. Academy, and the Royal Military College. The Regulations impose several obligations on the Public Service Board and the entities it governs. Firstly, the Board must ensure that the new salary scales are accurately implemented and communicated to the relevant officers. This includes updating any internal systems and documentation to reflect the new rates. Furthermore, the Regulations require that the salary differential between male and female officers be correctly applied, as per the amended sub-regulation (4). Employers must also ensure compliance with these new scales when making salary payments to their staff. Breach of these Regulations can lead to various consequences. While the specific offences and penalties are not detailed in the provided excerpt, generally, non-compliance with public service regulations can result in administrative penalties, including fines or other sanctions. Additionally, employees who do not receive the correct salary as per the Regulations may have grounds to lodge a complaint or seek redress through internal or external grievance mechanisms. Employers found to be in violation of these provisions may also face legal actions from affected employees, which could lead to further financial and reputational consequences.
