Overview

The Statutory Rules 1969 No. 174, titled "Regulations under the Public Service Act 1922-1968," was enacted in 1969 by the Governor-General in and over the Commonwealth of Australia, acting on the advice of the Federal Executive Council. This legislation was introduced to amend the Public Service (Parliamentary Officers) Regulations to address salary adjustments for officers of the Second and Third Divisions within the Public Service. The regulations were made in response to a need to revise and update the remuneration for these officers, reflecting changes in the economic conditions and the need to maintain equitable compensation within the public service. The policy objective of these regulations was to ensure that parliamentary officers received appropriate salary adjustments in line with the cost of living and the changing economic environment, thereby maintaining fair and competitive compensation within the public service. The enacting body for these regulations was the Parliament of Australia, which authorised the Governor-General to make these regulations under the Public Service Act 1922-1968. This legislative instrument aimed to rectify the outdated salary structures by amending the existing regulations to reflect the new rates of annual salary, thereby ensuring that officers of the Second and Third Divisions received fair and updated remuneration. The regulations also included provisions for transitional allowances to officers who were in service during the period before the commencement of these regulations, ensuring that their total remuneration was not adversely affected by the changes.

Scope and Application

The Statutory Rules 1969 No. 174, made under the Public Service Act 1922-1968, pertain to amendments of the Public Service (Parliamentary Officers) Regulations, specifically concerning the salaries of officers in the Second and Third Divisions. These regulations apply to parliamentary officers within the Commonwealth of Australia, affecting their remuneration. The amendments adjust the annual salary figures for these officers, with the Second Division officers' salaries rising from $9,500 to $11,250, and the Third Division officers' salaries increasing from $10,500 to $12,430. Additionally, the regulations provide for an allowance for officers who were in office during the transitional period before the regulations' commencement, ensuring their total remuneration does not decrease compared to the new salary rates. The regulations do not explicitly state any exclusions or thresholds, but their application is confined to officers affected by the salary changes within the specified divisions and period. The scope of the regulations is limited to the adjustments of salaries and allowances for the mentioned officers, with no indication of broader application or extensions through subordinate instruments.

Key Provisions

The Statutory Rules 1969 No. 174 amends the Public Service (Parliamentary Officers) Regulations under the Public Service Act 1922-1968. Regulation 71 has been modified to increase the annual salary figures for officers in the Second and Third Divisions. Specifically, the salary for Second Division officers has been increased from $9,500 to $11,250, and for Third Division officers from $10,500 to $12,430. This amendment takes effect from the date these Regulations come into force. The Regulations also impose an obligation on the Parliamentary Head to provide an allowance to officers who occupied their positions during the transitional period from September 22, 1969, to the commencement of these Regulations. This allowance is intended to ensure that the officers' total remuneration remains consistent with the new salary rates, compensating for any shortfall that might otherwise occur. This transitional allowance is calculated based on the difference between the old and new salary rates and the period of service during the transitional phase. Breach of these Regulations could have legal consequences, although specific offences, penalties, or consequences are not detailed in the provided text. Generally, failure to comply with statutory regulations could result in civil or administrative penalties under the relevant Act or Regulations. However, the precise nature of any penalties is not outlined here, and further consultation of the Public Service Act 1922-1968 or related legal instruments would be necessary to determine the specific consequences of non-compliance.
