Authority for payment of allowances.

2. The Parliamentary Head may authorize the payment of an allowance, in respect of the period that commenced on the twenty-third day of December, 1963, and ended on the day immediately before the commencement of these Regulations, to the officers who occupied during that period the office of Clerk-Assistant in the Department of the Senate and the office of Clerk-Assistant in the Department of the House of Representatives, respectively, of such an amount as would result in the total remuneration of each such officer being not less than the total remuneration that would have been payable to him in respect of that period if the amendments made by these Regulations had taken effect on the twenty-third day of December, 1963.

Overview

Statutory Rules 1964, No. 42, enacted on 12 March 1964, was introduced under the Public Service Act 1922-1964 to address the need for updated salary scales for officers in the Second and Third Divisions. This legislative instrument was notified in the Commonwealth Gazette on 19 March 1964 and was made by the Parliament to ensure that the remuneration of officers in these divisions is commensurate with their roles and responsibilities. The policy objective of this regulation is to provide a structured and fair salary scale that reflects the appropriate classification of offices within the specified divisions, thereby maintaining the integrity and functionality of the public service.

Scope and Application

The statutory rules 1964, No. 42, made under the Public Service Act 1922-1964, specify new rates for annual salaries or scales of annual salaries payable to male officers in the Second and Third Divisions of the Public Service. These regulations are applicable to officers who hold positions within the Commonwealth's public service, specifically within the Second and Third Divisions, and are effective from the date of their notification in the Commonwealth Gazette. The rules establish a detailed table of salary rates appropriate to each classified office, ensuring that officers receive remuneration consistent with their position within the public service hierarchy. Additionally, the regulations provide authority for the Parliamentary Head to make allowance payments retroactively to certain officers, ensuring that their total remuneration is not less than what they would have received had the new rates been in effect from the specified start date.

Key Provisions

The legislative instrument primarily amends Regulation 71 of the Public Service (Parliamentary Officers) Regulations under the Public Service Act 1922-1964, with specific focus on altering the annual salary rates for male officers in the Second and Third Divisions. The amendment outlines a new table of salary rates, replacing the previous sub-regulations (1.) and (1a.) (Regulation 1(b)). The new rates are designed to be appropriate to the classification of the office held by the officer, with specific amounts listed for each rank from the lowest to the highest (Regulation 1(b)(1.)). Additionally, the instrument authorises the Parliamentary Head to pay allowances to certain officers for a specified period, ensuring their total remuneration is not less than what it would have been if the amendments had taken immediate effect (Regulation 2). Under this legislation, the obligations of the Parliamentary Head are to ensure that the officers of the Second and Third Divisions receive salaries as per the new rates outlined in the table (Regulation 1(b)(1.)). Furthermore, the Parliamentary Head must authorise the payment of allowances to the Clerk-Assistants in the Department of the Senate and the Department of the House of Representatives for the period specified, to maintain their total remuneration at the levels it would have been if the amendments had applied retroactively (Regulation 2). The obligations also extend to the officers themselves, who must occupy the specified offices during the relevant period to be eligible for the allowances. Failure to comply with the provisions of this legislation could result in officers not receiving the correct salary or allowances as stipulated. However, the legislation does not explicitly outline offences, penalties, or specific consequences for breach. The maximum penalties would be determined by the Public Service Act 1922-1964 or other relevant legislation, depending on the nature and severity of the breach. The instrument's primary focus is on ensuring financial equity and proper remuneration for the specified officers, rather than on punitive measures.
