Overview

The Public Service (Parliamentary Officers) Regulations 1951 (Statutory Rules 1951, No. 78) were enacted to update and modernise the allowances and salaries for parliamentary officers within the Australian public service. These regulations were made under the authority of the Public Service Act 1922-1950, reflecting the need to adapt to changing economic conditions and ensure fair remuneration for officers in various divisions. The policy objective behind these regulations was to provide a structured and equitable framework for the salaries and allowances of parliamentary officers, ensuring that their compensation is reflective of their roles, responsibilities, and the cost of living. The regulations include detailed provisions for allowances such as travelling allowances, fares, and higher duties allowances, as well as comprehensive salary tables for officers in different divisions, taking into account factors such as gender and age. The amendments also introduced mechanisms for adjusting salaries based on variations in the cost of living, ensuring that officers' incomes remain competitive and sustainable over time.

Scope and Application

The Statutory Rules 1951, No. 78, made under the Public Service Act 1922-1950, modifies the Public Service (Parliamentary Officers) Regulations concerning allowances, fares, higher duties allowances, and salary structures for officers within the Second, Third, and Fourth Divisions of the public service. This legislative instrument applies to parliamentary officers employed by the Commonwealth government, impacting their remuneration, travel allowances, and salary increments. Notably, it establishes different allowances for married and unmarried officers, as well as distinctions based on residency in capital cities versus other areas. The regulations also detail specific salary bands and increments for various positions within these divisions, with further adjustments tied to the cost of living index. Subordinate instruments may further extend or restrict the application of these regulations, ensuring that the allowances and salaries are periodically reviewed and adjusted to reflect changes in economic conditions.

Key Provisions

The legislation primarily modifies the Public Service (Parliamentary Officers) Regulations by updating rates of travel allowances, fares, and higher duties allowances, as well as repealing and replacing certain parts of the Regulations concerning salaries and increments for officers in the Second, Third, and Fourth Divisions. Regulation 57 (section 1) revises travel allowances, with different rates based on the maximum salary of the position, whether the officer is married or unmarried, and the duration of residence. Regulation 64 (section 2) increases the fare allowance, and Regulation 66 (section 3) updates the higher duties allowance, stipulating that the amount is to be determined by the Parliamentary Head when an officer temporarily occupies a higher position. Additionally, the legislation repeals Parts IV and V of the Regulations and inserts new provisions regarding salaries and increments for officers in the Second, Third, and Fourth Divisions (sections 4 and 6). The Act imposes obligations on the Parliamentary Head and officers to adhere to the updated salary scales and allowances. The Parliamentary Head must determine the higher duties allowance for officers temporarily occupying higher positions, while officers must comply with the specified salary limits and increments based on their division and age. Furthermore, the Act mandates adjustments to officers' salaries based on variations in the cost of living, as measured by the index number published by the Commonwealth Court of Conciliation and Arbitration. There are no explicit offences, penalties, or civil/criminal consequences mentioned in the text for non-compliance with the provisions of this legislation. However, non-compliance could potentially lead to disputes regarding salary and allowances, which might be resolved through administrative or judicial processes. It is important to note that the text does not provide specific penalties for breaches, and any consequences would likely depend on the particular circumstances of the breach and applicable laws.
