Overview

The Regulations under the Public Service Act 1922-1964, enacted in 1964, aim to amend the existing Public Service (Parliamentary Officers) Regulations. This legislative instrument addresses issues related to the payment for Sunday duty and the scales of annual salaries for certain officers within various parliamentary departments. The Regulations were made by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, on the recommendation of the President of the Senate and the Speaker of the House of Representatives. The objective of these amendments is to ensure fair compensation for officers who work on Sundays, particularly when their hours exceed their normal weekly hours, and to revise the salary scales for specific positions within the parliamentary departments.

Scope and Application

The Regulations under the Public Service Act 1922-1964 apply to officers within the public service, specifically those who perform duties on Sundays, including male and female officers with various salary rates. These regulations are relevant to the Department of the Senate, the Department of the House of Representatives, the Department of the Parliamentary Library, and the Department of the Parliamentary Reporting Staff, as well as the Joint House Department. The regulations determine the pay rates for officers performing Sunday duties, with different rates depending on the officer's salary and the total hours worked. The amendments also establish that officers earning more than specified salary thresholds are not eligible for certain Sunday duty payments. The regulations extend their reach across the Commonwealth of Australia, impacting the federal public service and its operations. The amendments made through this statutory instrument do not introduce any specific exclusions but rather refine existing provisions related to Sunday duty pay.

Key Provisions

The statutory rules in question primarily amend the Public Service (Parliamentary Officers) Regulations, specifically focusing on Sunday duty provisions and salary scales for certain officers within various departments. Under the amended Regulation 65b, officers are entitled to specific pay rates for Sunday work depending on whether their Sunday duties exceed their normal weekly hours. For officers earning £1419 per annum or less (male) or £1265 per annum or less (female), the pay rate is double their hourly salary rate. For higher earners, the rate is either double the hypothetical hourly rate based on the lower salary threshold or the sum of the actual hourly rate plus half of the hypothetical hourly rate, whichever is greater. Officers performing Sunday duties that, when aggregated with the preceding week, do not exceed their normal weekly hours, are paid at their regular hourly rate. Notably, officers earning over £2594 per annum (male) or £2440 per annum (female) are ineligible for any special Sunday pay or compensatory days off, unless approved by the Parliamentary Head. These regulations impose clear obligations on officers regarding their Sunday duties and entitlement to additional pay. Officers must accurately report their Sunday work hours and ensure they fall within the specified categories to receive the appropriate compensation. Departmental heads must also verify that officers' salaries fall within the correct brackets to determine their eligibility for special Sunday pay. Furthermore, the regulations explicitly prohibit officers earning above the specified thresholds from receiving any Sunday pay or compensatory days off without explicit approval from the Parliamentary Head. Failure to comply with these regulations could result in officers not receiving the correct pay for their Sunday duties. While the specific penalties for non-compliance are not detailed within the statutory rules, breaches of public service regulations generally can lead to disciplinary actions, including formal warnings, fines, or even termination of employment, depending on the severity and intent behind the breach. Additionally, officers found to be ineligible for special Sunday pay due to exceeding salary thresholds but still receiving it could be subject to financial penalties or required to repay any erroneously received payments.
