Overview

The Public Service (Establishment of Independent Parliamentary Expenses Authority) Order 2017 was made to establish the Independent Parliamentary Expenses Authority as an Executive Agency to manage and oversee the expenses related to Members of Parliament (MPs) and their staff. Enacted by the Honourable Sir Peter Cosgrove AK MC (Ret’d), Governor-General of the Commonwealth of Australia, with the advice of the Federal Executive Council, this Order commenced on 3 April 2017. The primary objective of this legislation is to ensure transparency and accountability in the administration of expenses associated with parliamentary duties, thereby addressing potential gaps in the oversight and management of these expenses. The Order is made under section 65 of the Public Service Act 1999 and allocates specific responsibilities and functions to the newly established Independent Parliamentary Expenses Authority, including advising on and administering MP work expense matters, conducting audits, and preparing relevant reports.

Scope and Application

The Public Service (Establishment of Independent Parliamentary Expenses Authority) Order 2017 applies to matters concerning designated parliamentary benefits and travel expenses of members of parliament (MPs) and their staff. The Order, made under section 65 of the Public Service Act 1999, establishes the Independent Parliamentary Expenses Authority as an Executive Agency. This entity is tasked with advising on and administering expenses related to MPs' parliamentary work, including benefits and travel expenses. The Order also details the types of travel-related expenses that can be claimed and outlines the functions of the Independent Parliamentary Expenses Authority, such as monitoring expenses, conducting audits, and preparing reports. The Order commenced on 3 April 2017, and its application extends to any matters occurring before, on, or after this date. The Order does not specify any exclusions or exemptions, but it does empower the responsible Minister to specify particular matters for monitoring or reporting, thereby extending or restricting its application through subordinate instruments.

Key Provisions

The Public Service (Establishment of Independent Parliamentary Expenses Authority) Order 2017 (section 1) establishes the Independent Parliamentary Expenses Authority as an Executive Agency, with its name and the title of its Head of Agency specified (section 6(2) and (3)). The responsible Minister for administering the Parliamentary Entitlements Act 1990 is designated as the Minister responsible for the Agency (section 6(4)). The Order defines various terms, such as "designated parliamentary benefit," "incidentals," and "MOPS travel allowance," which are integral to understanding the scope and application of the Authority's functions (section 4). The Independent Parliamentary Expenses Authority has several key functions, including advising on and administering matters related to Member of Parliament (MP) work expenses and Members of Parliament (Staff) travel expenses (section 6(5)(a)-(m)). The Authority is tasked with monitoring specified matters, preparing reports, conducting audits, and performing general administrative duties as required by the responsible Minister (section 6(5)). Additionally, the Authority is responsible for carrying out any functions conferred upon it by relevant laws, such as the Parliamentary Entitlements Act 1990 or the Members of Parliament (Staff) Act 1984 (section 6(5)(k)-(l)). Under the Order, there are no explicit offences or penalties detailed for breaches of its provisions. However, given the sensitive nature of the Independent Parliamentary Expenses Authority's role in overseeing parliamentary expenses, any significant mismanagement or misconduct could potentially lead to administrative or political repercussions. The Order operates under the framework of existing laws and regulations, which may include penalties for misuse of public funds or other related infractions, though these are not explicitly stated within the Order itself.
