Overview

The Public Health (Jervis Bay Territory) (Emergency Declaration) Repeal Instrument 2023 was enacted to address the problem of outdated emergency public health measures in the Jervis Bay Territory, following the cessation of the COVID-19 pandemic-related emergency declarations. This instrument, made under the authority of the Public Health Act 1997 (ACT) and in force in the Jervis Bay Territory under the Jervis Bay Territory Acceptance Act 1915 (Cth), repeals several emergency declaration instruments that were previously enacted to manage the public health crisis. The policy objective is to ensure that the legislative framework in the Jervis Bay Territory is current and responsive to the current public health landscape, thereby facilitating the transition from emergency measures to normal public health protocols.

Scope and Application

The Public Health (Jervis Bay Territory) (Emergency Declaration) Repeal Instrument 2023 is a statutory instrument made under section 119 of the Public Health Act 1997 (ACT), as in force in the Jervis Bay Territory. This instrument repeals a series of emergency declarations that were previously made under the same Act to address public health concerns, specifically in response to the COVID-19 pandemic. The repealed instruments include various extensions of the initial emergency declaration, each of which had been enacted to provide additional powers and measures aimed at managing the public health crisis. These repealed instruments no longer apply following their repeal by this instrument, which effectively revokes the emergency measures that had been in place. The repeal takes effect from the day after the instrument is registered, thereby bringing an end to the emergency status that had been declared in response to the pandemic within the Jervis Bay Territory.

Key Provisions

The Public Health (Jervis Bay Territory) (Emergency Declaration) Repeal Instrument 2023 (sections 1-4) revokes several previously enacted emergency declaration instruments issued in response to a public health emergency in the Jervis Bay Territory. The instrument, made under section 119 of the Public Health Act 1997 (ACT), specifies that each instrument listed in Schedule 1 is repealed (section 4). The repealed instruments include the Public Health (Jervis Bay Territory) Emergency Declaration 2020 and its subsequent extensions through 2021 and 2022, all of which were aimed at managing the public health emergency in the Jervis Bay Territory. These instruments collectively provided the legal framework for measures and restrictions implemented to safeguard public health during the emergency period. The repealed instruments impose certain obligations and requirements on individuals and entities within the Jervis Bay Territory. These obligations include adherence to public health directives, such as restrictions on gatherings, business operations, and travel, which were designed to mitigate the spread of the relevant health threat. The repealed instruments also authorised the Chief Health Officer to issue further directions and regulations to manage the emergency, ensuring compliance with public health measures. Additionally, the instruments provided for the allocation of resources and support to affected individuals and businesses, as well as mechanisms for enforcement and compliance monitoring. Breaches of the repealed emergency declaration instruments could have resulted in various civil or criminal consequences, depending on the specific provisions of the instruments and the applicable laws. The Public Health Act 1997 (ACT) and related regulations likely provided for penalties for non-compliance, which could include fines and, in some cases, imprisonment. The maximum penalties would have been determined by the specific provisions of each repealed instrument and the relevant legislative framework in place at the time. Enforcement of these instruments would have been carried out by authorised officers under the Public Health Act 1997 (ACT), who had the authority to issue infringement notices, take legal action, or seek court orders to compel compliance with the public health measures.
