Public Governance, Performance and Accountability Act 2013

Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 20212022 (No. 1) (the amendment determination)

Purpose of the determination

The amendment determination is made under section 75 of the Public Governance, Performance and Accountability Act 2013 (PGPA Act), to adjust amounts appropriated to non-corporate Commonwealth entities, in response to a recent Machinery of Government change.

On 2 July 2021, the Governor-General made amendments to the Administrative Arrangements Order made on 18 March 2021 including the transfer of responsibility for Northern Australia policy and coordination and the Northern Australia Infrastructure Facility Act 2016 from the Department of Industry, Science, Energy and Resources to the Department of Infrastructure, Transport, Regional Development and Communications.

On 5 July 2021, the Prime Minister agreed to the transfer of the functions below to support the revised mandate of the Digital Transformation Agency (DTA):

  • Digital Identity (integrated delivery management), from DTA to Services Australia;
  • data.gov.au, from DTA to the Australian Bureau of Statistics;
  • Government Domain Names, from DTA to the Department of Finance;
  • Australian Government Style Manual and Digital Professions, from DTA to the Australian Public Service Commission; and
  • COVIDSafe app, from DTA to the Department of Health.

The amendment determination modifies the Appropriation Act to reflect these transfers and results in no change to the total amount appropriated by Parliament.

Commencement

The amendment determination commences on the day after registration.

Authority for the determination

Section 75 of the PGPA Act enables the Finance Minister to determine that one or more Schedules to one or more Appropriation Acts are modified in a specified way in relation to the transfer of a function from one non-corporate Commonwealth entity to another.

Under section 107 of the PGPA Act, the Finance Minister has delegated the power to make determinations under section 75 to the Secretary of the Department of Finance. Under section 109 of the PGPA Act, the Secretary has, in turn, subdelegated this power to certain officials within the Department of Finance, including the official who made this determination.

The amendment determination amends the Public Governance, Performance and Accountability (Section 75 Transfers) Determination 20212022 (the Determination), which is a legislative instrument for the purposes of section 8 of the Legislation Act 2003.

Statement of Compatibility with Human Rights

A Statement of Compatibility with Human Rights is not required for the amendment determination.

Subsection 9(1) of the Human Rights (Parliamentary Scrutiny) Act 2011 requires a Statement of Compatibility with Human Rights for all legislative instruments subject to disallowance under section 42 of the Legislation Act 2003. A determination, including an amendment determination, under section 75 of the PGPA Act is exempt from disallowance under subsection 75(7) of the PGPA Act. As such, a Statement of Compatibility with Human Rights is not required.

Consultation

Consistent with Chapter 3, Part 1 of the Legislation Act 2003, the affected entities were consulted in the preparation of the amendment determination.

Overview

The Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2021-2022 (No. 1) was enacted to adjust appropriations for non-corporate Commonwealth entities following recent changes in government portfolios. This amendment determination was made under section 75 of the Public Governance, Performance and Accountability Act 2013 (PGPA Act) and was introduced to address the need for reallocation of funds in response to the transfer of specific functions and responsibilities between departments. The enacting body for this amendment is the Secretary of the Department of Finance, who has been delegated this authority by the Finance Minister. The policy objective is to ensure that the financial appropriations are aligned with the revised mandates of the respective departments following the transfers. The amendment determination modifies the Appropriation Act to reflect these changes, ensuring that there is no net change to the total amount appropriated by Parliament.

Scope and Application

The Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2021-2022 applies to the modification of appropriations to non-corporate Commonwealth entities following a Machinery of Government change. This amendment determination was made under section 75 of the Public Governance, Performance and Accountability Act 2013 and is designed to adjust appropriations in response to recent transfers of responsibility among various departments. Specifically, it reflects changes including the transfer of Northern Australia policy and coordination, along with the Northern Australia Infrastructure Facility Act 2016, from the Department of Industry, Science, Energy and Resources to the Department of Infrastructure, Transport, Regional Development and Communications, as well as the reallocation of certain functions within the Digital Transformation Agency. This amendment ensures that the total amount appropriated by Parliament remains unchanged. The amendment determination applies nationally within the Commonwealth and is effective from the day after registration. There are no stated exclusions or exemptions in this determination, and it is not subject to disallowance under the Legislation Act 2003.

Key Provisions

The Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2021-2022 (No. 1) (the amendment determination) modifies the Appropriation Act to reflect recent changes in the administrative arrangements of the Commonwealth government. The amendment determination, made under section 75 of the Public Governance, Performance and Accountability Act 2013 (PGPA Act), adjusts appropriations to non-corporate Commonwealth entities in response to the transfer of functions related to Northern Australia policy and coordination, and the Digital Transformation Agency (DTA) from one department to another. Specifically, the amendment determination inserts a new paragraph 5(1A) to include the Northern Australia Infrastructure Facility in the Infrastructure, Transport, Regional Development and Communications Portfolio (Item 1). It also modifies several appropriation items to reflect the transfer of functions such as Digital Identity, data.gov.au, Government Domain Names, Australian Government Style Manual and Digital Professions, and the COVIDSafe app between various departments (Items 2 and 3). The amendment determination imposes obligations on the entities involved by adjusting their appropriation items as per the changes in function and responsibility. The entities must ensure that their financial allocations are updated in accordance with the amendment determination. The Department of Infrastructure, Transport, Regional Development and Communications, for instance, will have its appropriation increased by $14,227,000.00 under the Northern Australia Infrastructure Facility. Similarly, Services Australia, the Australian Bureau of Statistics, and other affected departments will have their appropriations adjusted as specified in the amendment. There are no specific offences, penalties, or civil/criminal consequences outlined for breaches of the amendment determination itself, as it primarily serves to adjust appropriation amounts rather than impose new regulatory requirements. However, any entity that fails to comply with the updated appropriations as specified in the amendment determination may face financial discrepancies and potential scrutiny from the Department of Finance or the relevant parliamentary committees. This could lead to administrative or procedural consequences, although no specific penalties are stated within the amendment determination. The amendment determination commences on the day after registration, and it is made under the authority granted by section 75 of the PGPA Act, with consultation undertaken with the affected entities as required by the Legislation Act 2003.
