Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 20172018 (No. 8) (the amendment determination)

Purpose of the determination

The amendment determination is made under section 75 of the Public Governance, Performance and Accountability Act 2013 (PGPA Act), to adjust amounts appropriated to non-corporate Commonwealth entities, in response to the establishment of the NDIS Quality and Safeguards Commission (NDISQSC). NDISQSC commenced on 1 July 2018 by the National Disability Insurance Scheme Act 2013 as amended by the National Disability Insurance Scheme Amendment (Quality and Safeguards Commission and Other Measures) Act 2017.

The amendment determination modifies the Appropriation Acts to support functions transferred to NDISQSC from the Department of Social Services in relation to the implementation of the NDIS Quality and Safeguarding Framework.

The amendment determination results in no change to the total amount appropriated by Parliament.

Commencement

The amendment determination commences on 30 June 2019.

Authority for the determination

Section 75 of the PGPA Act enables the Finance Minister to determine that one or more Schedules to one or more Appropriation Acts are modified in a specified way in relation to the transfer of a function from one non-corporate Commonwealth entity to another.

Under section 107 of the PGPA Act, the Finance Minister has delegated the power to make determinations under section 75 to the Secretary of the Department of Finance. Under section 109 of the PGPA Act, the Secretary has, in turn, subdelegated this power to certain officials within the Department of Finance, including the official who made the determination.

The amendment determination amends the Public Governance, Performance and Accountability (Section 75 Transfers) Determination 20172018 (the Determination), which is a legislative instrument for the purposes of section 8 of the Legislation Act 2003.

Statement of Compatibility with Human Rights

A Statement of Compatibility with Human Rights is not required for the amendment determination. Subsection 9(1) of the Human Rights (Parliamentary Scrutiny) Act 2011 requires a Statement of Compatibility with Human Rights for all legislative instruments subject to disallowance under section 42 of the Legislation Act 2003. A determination, including an amendment determination, under section 75 of the PGPA Act is exempt from disallowance under subsection 75(7) of the PGPA Act. As such, a Statement of Compatibility with Human Rights is not required.

Consultation

Consistent with Chapter 3, Part 1 of the Legislation Act 2003, the affected entities were consulted in the preparation of the amendment determination.

Overview

The Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2017-2018 was enacted to facilitate the transfer of specific functions and appropriations from the Department of Social Services to the newly established NDIS Quality and Safeguards Commission (NDISQSC) on 1 July 2018. This amendment determination is a legislative instrument made under section 75 of the Public Governance, Performance and Accountability Act 2013, empowering the Finance Minister to modify Appropriation Acts in relation to the transfer of functions between non-corporate Commonwealth entities. The purpose of this amendment is to ensure that the necessary appropriations are reallocated to support the NDISQSC's role in implementing the NDIS Quality and Safeguarding Framework without altering the overall amount appropriated by Parliament. This adjustment is integral to maintaining the integrity of the NDIS and ensuring that quality and safeguarding measures are effectively administered. The amendment determination was initiated by the Australian Parliament and aims to streamline the financial governance of the NDISQSC within the broader framework of the PGPA Act.

Scope and Application

The Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2017-2018 is an instrument made under section 75 of the Public Governance, Performance and Accountability Act 2013, which enables the Finance Minister to modify the appropriation amounts for non-corporate Commonwealth entities. This amendment determination adjusts the amounts appropriated to these entities in response to the establishment of the NDIS Quality and Safeguards Commission on 1 July 2018, modifying the Appropriation Acts to support the functions transferred from the Department of Social Services to the NDIS Quality and Safeguards Commission in relation to the implementation of the NDIS Quality and Safeguarding Framework. The amendment ensures that there is no change to the total amount appropriated by Parliament. The determination applies to the relevant appropriation items in Schedule 1 of the Appropriation Act (No 1) 2017-2018 within the Social Services Portfolio, specifically modifying the amounts for the Department of Social Services and the NDIS Quality and Safeguards Commission. The amendment determination commences on 30 June 2019 and is made in accordance with the authority granted under section 75 of the PGPA Act, with the power delegated to certain officials within the Department of Finance.

Key Provisions

The main operative sections of the Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2017-2018 (No. 8) (the amendment determination) (subsections 6(2)(g) and 6(2)(h) and items 5 and 28 in subsection 6(3)) provide for adjustments to the appropriation amounts allocated to the Department of Social Services and the NDIS Quality and Safeguards Commission (NDISQSC) under the Appropriation Act (No. 1) 2017-2018, following the establishment of the NDISQSC. Specifically, this amendment determination has effect as if the NDISQSC were included in the Appropriation Act (No. 1) 2017-2018 and it includes a new outcome for the NDISQSC that is related to the promotion of quality supports and services for people with disability under the NDIS. The amendment determination imposes specific obligations and requirements on the entities it governs, including the Department of Social Services and the NDISQSC. It requires the reallocation of funds from the Department of Social Services to the NDISQSC in accordance with the specified amounts outlined in the amendment determination. This reallocation reflects the transfer of functions from the Department of Social Services to the NDISQSC in relation to the implementation of the NDIS Quality and Safeguarding Framework. Additionally, the amendment determination requires the inclusion of the NDISQSC in the Appropriation Act (No. 1) 2017-2018 and the addition of a new outcome for the NDISQSC, which is related to the promotion of quality supports and services for people with disability under the NDIS. There are no specific offences, penalties, or civil/criminal consequences outlined in the amendment determination for breach. However, the determination is made under section 75 of the Public Governance, Performance and Accountability Act 2013 (PGPA Act), which enables the Finance Minister to adjust amounts appropriated to non-corporate Commonwealth entities in response to the transfer of a function. The amendment determination results in no change to the total amount appropriated by Parliament, ensuring that the overall budget remains balanced and in accordance with the appropriations approved by Parliament.
