EXPLANATORY STATEMENT

Public Governance, Performance and Accountability Act 2013

Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 20162017 (No. 5) (the amendment determination)

Purpose of the determination

The amendment determination modifies the 20162017 Appropriation Acts to support functions transferred from:

the Fair Work Commission (FWC) to the Fair Work Ombudsman and Registered Organisations Commission Entity (FWOROCE) in relation to a suite of registered organisations matters formerly undertaken by the FWC; and

the Office of the Fair Work Ombudsman (OFWO) to FWOROCE in relation to all functions formerly undertaken by the OFWO.

The Public Governance, Performance and Accountability Amendment (Fair Work Ombudsman and Registered Organisations Commission Entity) Rules 2017 adds a new listed entity, the FWOROCE, to Schedule 1 to the Public Governance, Performance and Accountability Rule 2014 and repeals the listing for OFWO, both commencing 1 May 2017, for purposes of the Public Governance, Performance and Accountability Act 2013 (PGPA Act).

The amendment determination is made under section 75 of the PGPA Act to amend the Public Governance, Performance and Accountability (Section 75 Transfers) Determination 20162017 (the Determination).

The amendment determination results in no change to the total amount appropriated by Parliament.

Commencement

The amendment determination commences on 1 May 2017.

Authority for the determination

Section 75 of the PGPA Act enables the Finance Minister to determine that one or more Schedules to one or more Appropriation Acts are modified in a specified way in relation to the transfer of a function from one non-corporate Commonwealth entity to another.

Under section 107 of the PGPA Act, the Finance Minister has delegated the power to make determinations under section 75 to the Secretary of the Department of Finance. Under section 109 of the PGPA Act, the Secretary has, in turn, subdelegated this power to certain officials within the Department of Finance, including the official who made the determination.

The amendment determination amends the Determination, which is a legislative instrument for the purposes of section 8 of the Legislation Act 2003.

Statement of Compatibility with Human Rights

A Statement of Compatibility with Human Rights is not required for the amendment determination.
Subsection 9(1) of the Human Rights (Parliamentary Scrutiny) Act 2011 requires a Statement of Compatibility with Human Rights for all legislative instruments subject to disallowance under
section 42 of the Legislation Act 2003. A determination, including an amendment determination, under section 75 of the PGPA Act is exempt from disallowance under subsection 75(7) of the PGPA Act. As such, a Statement of Compatibility with Human Rights is not required.

Consultation

Consistent with Chapter 3, Part 1 of the Legislation Act 2003, the affected entities were consulted in the preparation of the amendment determination.

Summary of Modifications

1. Item 1 of the amendment determination modifies the definition of Appropriation Act, in section 4 of the Determination, to include all 20162017 Appropriation Acts to date.

2. Item 2 of the amendment determination repeals and substitutes section 6 of the Determination with a new section 6. Overview

The Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2016-2017 (No. 5) was enacted to facilitate the transfer of specific functions from the Fair Work Commission, the Office of the Fair Work Ombudsman, and other entities to the Fair Work Ombudsman and Registered Organisations Commission Entity. This amendment determination, made under section 75 of the Public Governance, Performance and Accountability Act 2013, modifies the 2016-2017 Appropriation Acts to reflect these transfers. It ensures that the appropriation items are correctly assigned to the new entities while maintaining the total amount appropriated by Parliament. The determination was enacted by the Secretary of the Department of Finance, who has been delegated this power under the PGPA Act. The objective of this amendment is to streamline the allocation of funds and responsibilities in line with the structural changes within the entities involved.

Scope and Application

The amendment determination, which modifies the 2016-2017 Appropriation Acts, applies to functions transferred from the Fair Work Commission (FWC) to the Fair Work Ombudsman and Registered Organisations Commission Entity (FWOROCE) and from the Office of the Fair Work Ombudsman (OFWO) to FWOROCE. The amendment determination affects the appropriation of funds for these entities, ensuring that the total appropriation remains unchanged despite the transfers. The amendment determination is made under section 75 of the Public Governance, Performance and Accountability Act 2013 (PGPA Act), and it amends the Public Governance, Performance and Accountability (Section 75 Transfers) Determination 2016-2017. The amendment determination includes no changes to the total amount appropriated by Parliament, ensuring a balanced budget despite the function transfers. The amendment determination has a national jurisdictional reach, impacting entities within the Commonwealth of Australia. The Public Governance, Performance and Accountability Amendment (Fair Work Ombudsman and Registered Organisations Commission Entity) Rules 2017, which add FWOROCE to Schedule 1 of the Public Governance, Performance and Accountability Rule 2014 and repeal the listing for OFWO, also apply on a national level. These rules, which commence on 1 May 2017, are made under the PGPA Act and result in no change to the total amount appropriated by Parliament. The amendment determination and the rules do not explicitly state any exclusions, exemptions, or thresholds, but they are designed to facilitate the transfer of functions without affecting the overall appropriation. The amendment determination is made by the Secretary of the Department of Finance, who has been delegated this power by the Finance Minister under section 75 of the PGPA Act.

Key Provisions

The key operative sections of the Public Governance, Performance and Accountability (Section 75 Transfers) Amendment Determination 2016–2017 (No. 5) modify the 2016–2017 Appropriation Acts to accommodate the transfer of functions from the Fair Work Commission (FWC) and the Office of the Fair Work Ombudsman (OFWO) to the Fair Work Ombudsman and Registered Organisations Commission Entity (FWOROCE). Specifically, the amendment determination modifies the definition of Appropriation Act in section 4 of the Determination to include all 2016–2017 Appropriation Acts to date. It also introduces new paragraphs and items to sections 6 and 7 of the Determination to reflect the transfer of functions, with the FWOROCE being included in the Supply Act (No. 1) 2016–2017 and the Appropriation Act (No. 1) 2016–2017 within the Employment Portfolio. The amendment determination also adds sections 8 and 9 that apply to appropriation items in Schedule 2 to the Appropriation Act (No. 2) 2016–2017 and Schedule 1 to the Appropriation Act (No. 3) 2016–2017, respectively. The amendment determination imposes obligations on the entities involved in the transfer of functions, including the FWC, OFWO, and FWOROCE. The FWC and OFWO are required to transfer their functions to the FWOROCE, while the FWOROCE is required to assume these functions and operate within the framework established by the amendment determination. The amendment determination also imposes obligations on the Department of Finance and its officials, who are responsible for making the determination and ensuring that the appropriate modifications are made to the Appropriation Acts. Breach of the amendment determination or the underlying legislation could result in various civil and criminal consequences. For example, under section 33 of the PGPA Act, a person who contravenes a provision of the Act, including the amendment determination, may be liable for a civil penalty of up to $21,000 for each contravention. Additionally, under section 12.2 of the Criminal Code Act 1995, a person who intentionally or recklessly contravenes a provision of the PGPA Act or the amendment determination may be guilty of an offence and liable to a penalty of up to $210,000 or imprisonment for up to five years, or both. It is important to note that these penalties are subject to the discretion of the court and may vary depending on the circumstances of the case.
