Overview

The Public Governance, Performance and Accountability Amendment (Special Account Determination) Rules 2021 were enacted to address the impending sunset of the Financial Management and Accountability (Establishment of Special Account for ComSuper) Determination 2011/06. This determination, which was set to expire on 1 October 2021, established the Commonwealth Superannuation Corporation (ComSuper) Special Account. The Amendment Rules, made under the authority of the Public Governance, Performance and Accountability Act 2013 (PGPA Act), serve to replace this outdated determination with the PGPA Act Determination (Commonwealth Superannuation Corporation SOETM Special Account 2021). The Amendment Rules aim to ensure that relevant Commonwealth banking policies continue to apply to the ComSuper with respect to the monies it handles on behalf of the Commonwealth. These rules amend the Public Governance, Performance and Accountability Rule 2014 to update the name of the determination that establishes the ComSuper Special Account and to create transitional arrangements between the previous and current ComSuper Special Accounts. The Amendment Rules were developed by the Office of Parliamentary Counsel in consultation with the Australian Government Solicitor, and they are compatible with the human rights and freedoms recognised or declared in the international instruments listed in the Human Rights (Parliamentary Scrutiny) Act 2011. The rules were made to ensure a seamless transition and to maintain the integrity of the financial management framework governing Commonwealth entities, particularly the ComSuper.

Scope and Application

The Public Governance, Performance and Accountability Amendment (Special Account Determination) Rules 2021 amends the Public Governance, Performance and Accountability Rule 2014 to ensure that relevant Commonwealth banking policies continue to apply to the Commonwealth Superannuation Corporation with respect to monies it handles on behalf of the Commonwealth. These rules are applicable to the Commonwealth Superannuation Corporation and Commonwealth entities as defined under the Public Governance, Performance and Accountability Act 2013. The Amendment Rules update the name of the determination that establishes the ComSuper Special Account from the Financial Management and Accountability (Establishment of Special Account for ComSuper) Determination 2011/06 to the PGPA Act Determination (Commonwealth Superannuation Corporation SOETM Special Account 2021). Furthermore, the Amendment Rules introduce transitional arrangements in a new Part 10, addressing the transition between the previous and current ComSuper Special Accounts. The Amendment Rules are made under the authority of the Public Governance, Performance and Accountability Act 2013 and commence at the same time as the PGPA Act Determination (Commonwealth Superannuation Corporation SOETM Special Account 2021). No exclusions, exemptions, or thresholds are specified in the Amendment Rules, and they are compatible with human rights as they do not engage any of the applicable rights or freedoms.

Key Provisions

The Public Governance, Performance and Accountability Amendment (Special Account Determination) Rules 2021 (Amendment Rules) amend the Public Governance, Performance and Accountability Rule 2014 (PGPA Rule) in several key ways. Primarily, it updates the reference to the special account for the Commonwealth Superannuation Corporation (ComSuper) from the Financial Management and Accountability (Establishment of Special Account for ComSuper) Determination 2011/06 to the PGPA Act Determination (Commonwealth Superannuation Corporation SOETM Special Account 2021) (sections 4 and 18A(1)(d)). Additionally, it introduces transitional provisions to ensure a smooth transition between the old and new special accounts (section 41). These amendments ensure that existing Commonwealth banking policies continue to apply to ComSuper as it handles Commonwealth funds. The Amendment Rules impose specific obligations on the Commonwealth Superannuation Corporation and other relevant entities governed by the PGPA Act. It requires them to comply with the updated determination and the transitional provisions outlined in the Amendment Rules. This includes ensuring that all relevant banking policies and procedures are aligned with the new special account structure. Specifically, paragraph 18A(1)(d) mandates the adoption of the new PGPA Act Determination, while section 41 requires continued application of the PGPA Rule to applicable amounts received before the commencement of the Amendment Rules. The Amendment Rules do not explicitly outline specific offences, penalties, or civil/criminal consequences for breaches. However, non-compliance with the PGPA Act or the PGPA Rule could result in general sanctions under the PGPA Act, including financial penalties or other enforcement actions. The overarching legal framework provided by the PGPA Act and the PGPA Rule may also impose additional obligations and potential penalties for non-compliance with the amended rules. In conclusion, the Amendment Rules are designed to ensure the continued application of relevant Commonwealth banking policies to ComSuper by updating the special account reference and providing transitional arrangements. They impose clear obligations on ComSuper and other relevant entities to adhere to the updated rules, ensuring the integrity and effectiveness of the financial management framework established by the PGPA Act. While the Amendment Rules themselves do not specify penalties for non-compliance, the broader legal framework under the PGPA Act may impose significant consequences for breaches.
