Overview

The Public and Educational Lending Rights (Better Income for Authors) Consequential Amendments and Transitional Provisions Act 2026 was enacted to address the transitional and consequential issues that arose following the introduction of the Public and Educational Lending Rights (Better Income for Authors) Act 2026. This Act was passed by the Parliament of Australia to ensure a smooth transition from the old legislative framework, specifically the Public Lending Right Act 1985, to the new regime established by the Public and Educational Lending Rights (Better Income for Authors) Act 2026. The Act outlines provisions to maintain continuity in certain entitlements, decisions, and payments under the old scheme while simultaneously transferring functions and powers to the newly established Public and Educational Lending Rights Committee. The policy objective of this Act is to facilitate an orderly and efficient transition without unduly disrupting existing entitlements or obligations. The Act received Royal Assent on 20 May 2026 and its schedules detail the repeal of the Public Lending Right Act 1985, transitional arrangements for committee members, and continued operation of the old scheme for specific purposes until 30 June 2029, unless exempted by certain conditions.

Scope and Application

The Public and Educational Lending Rights (Better Income for Authors) Consequential Amendments and Transitional Provisions Act 2026 is designed to manage the consequential and transitional issues arising from the introduction of the Public and Educational Lending Rights (Better Income for Authors) Act 2026. This Act applies to individuals and entities involved in the operations of the Public Lending Right Scheme, including authors, libraries, and other stakeholders affected by the lending rights regime. The legislation applies across Australia, ensuring consistency and continuity in the administration of lending rights throughout the Commonwealth. The Act repeals the Public Lending Right Act 1985 and provides for the continued operation of the Public Lending Right Scheme in relation to entitlements and decisions made prior to the commencement of this Act, as well as for certain ongoing payments and claims. It also facilitates the transition of members from the old Public Lending Right Committee to the new Public and Educational Lending Rights Committee, ensuring that their terms and conditions are maintained during the transition period. Furthermore, the Act allows the Minister to issue legislative instruments to address any transitional matters not covered by the Act itself, provided these instruments do not create offences, grant certain powers, impose taxes, or directly amend the Act.

Key Provisions

The Public and Educational Lending Rights (Better Income for Authors) Consequential Amendments and Transitional Provisions Act 2026, referred to as the Act, provides a framework for the transitional and consequential amendments arising from the enactment of the Public and Educational Lending Rights (Better Income for Authors) Act 2026. This Act repeals the Public Lending Right Act 1985 (sections 1 to 3) and introduces transitional provisions to ensure a smooth transition from the old scheme to the new one. Section 2 outlines the commencement dates for different provisions of the Act, with the majority of sections starting on the day the Act receives Royal Assent, 20 May 2026. However, Schedules 1 and 2 commence at the same time as section 3 of the Public and Educational Lending Rights (Better Income for Authors) Act 2026, unless that section does not commence at all. The Act imposes certain obligations and requirements on the entities it governs. For example, Schedule 2, section 2 provides for the limited continued operation of the Public Lending Right Scheme in relation to specific entitlements and decisions made under the old scheme. This includes entitlements to payments that arose before the commencement of this Act, decisions made by the old committee before its commencement, and payments made under the old scheme. Additionally, section 3 of Schedule 2 ensures that members of the old committee are transitioned to the new committee, maintaining their terms and conditions of office for the balance of their terms. The Act also sets out the consequences for non-compliance with its provisions. Section 3 of Schedule 2 provides that a payment under the old scheme must not be made after the third 30 June following the commencement of this item, unless the payment is made due to the operation of subsection 25(2) of the old scheme, a decision of the Administrative Review Tribunal, or an order of a court. Failure to comply with these provisions may result in legal consequences, although specific penalties are not outlined within the Act itself. In summary, the Act provides a transitional framework for the changes brought about by the Public and Educational Lending Rights (Better Income for Authors) Act 2026, ensuring that existing entitlements and decisions are respected while laying the groundwork for the new scheme. The transitional provisions are designed to facilitate a seamless transition while maintaining the integrity of the old scheme until it is no longer applicable.
