Overview

The PSS (Maximum Benefits) Determination No. 4, enacted in 1999, serves to amend the maximum benefit levels applicable to ordinary members and scheme members employed by the Australian Federal Police under the Superannuation Act 1990. This legislative instrument was made by the PSS Board in accordance with the Rules for the Administration of the Superannuation Scheme. The purpose of this determination is to update the maximum benefit levels to reflect changes in salary brackets and other relevant factors, ensuring that the benefits provided remain fair and relevant for the members of the superannuation scheme. The amendments to the Principal Determination specifically involve the adjustment of dollar amounts in various schedules to reflect the new maximum benefit levels effective from 1 July 1999. This ensures the scheme continues to meet the needs of its members while remaining compliant with legislative requirements.

Scope and Application

The PSS (Maximum Benefits) Determination No. 4, made under the Superannuation Act 1990, applies specifically to members of the Public Sector Superannuation Scheme (PSS), including ordinary scheme members and those employed by the Australian Federal Police (AFP). It modifies the maximum benefit levels for these members, effective from 1 July 1999. The determination amends the Principal Determination, which is the PSS (Maximum Benefits) Determination No. 1, by updating the dollar amounts outlined in specific tables within the Rules for the Administration of the Superannuation Scheme. This adjustment ensures that the maximum benefits for ordinary members and AFP employees reflect current economic conditions and legislative intent. The application of this determination is confined to the Commonwealth jurisdiction, impacting only those individuals and entities governed by the PSS within the Australian Federal framework. The changes pertain solely to the financial limits of superannuation benefits and do not extend to other aspects of superannuation regulation or administration.

Key Provisions

The PSS (Maximum Benefits) Determination No. 4, made pursuant to rules 5.6.5 and 5.7.7 of the Rules, amends the maximum benefit levels for ordinary scheme members and those employed by the Australian Federal Police under the Superannuation Act 1990. This determination, which takes effect from 1 July 1999, revises the maximum benefits outlined in the PSS (Maximum Benefits) Determination No. 1, as amended, by replacing the dollar amounts set out in the relevant schedules with new figures. This revision is intended to align benefit levels with the current economic and legislative context. Entities and individuals governed by the Superannuation Act 1990 must comply with the new maximum benefit levels specified in this determination. Specifically, ordinary scheme members and those employed by the Australian Federal Police will have their benefits calculated according to the new figures provided in Schedules 1, 2, and 3. These schedules detail the maximum benefits based on the average salary or final average salary of the members. Trustees and administrators of the superannuation scheme must ensure that these new benefit levels are correctly applied when calculating and distributing benefits. Failure to comply with the provisions of this determination could lead to legal consequences. Although the document does not explicitly state the penalties for non-compliance, breaches of the Superannuation Act 1990 can result in civil and criminal penalties. These may include fines and imprisonment, depending on the severity of the breach. The exact penalties would be determined based on the relevant provisions of the Act and the circumstances of the non-compliance.
