Overview
The Statutory Rules 1979 No. 141, made under the War Precautions Act Repeal Act 1920, serve to amend the Protection of Word "Anzac" Regulations, providing specific adjustments to the prohibition on the use of the word "Anzac" in trade. Enacted by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, these regulations aim to refine the exceptions to the general prohibition, particularly around the use of "Anzac Day" in the context of entertainments held on or around 25 April. This legislative instrument addresses a need to clarify the circumstances under which the term "Anzac Day" can be used without contravening the regulations, thereby preserving the significance of Anzac Day while accommodating certain public activities and events. The underlying policy objective is to maintain the sanctity and respect associated with the Anzac commemorations while allowing for some flexibility in their public expression.
Scope and Application
The Protection of Word "Anzac" Regulations, as amended by these Statutory Rules, primarily concern the use of the term "Anzac" in commercial contexts, particularly in relation to trade and entertainment. These regulations apply to any person or entity engaged in commercial activities that involve the use of the term "Anzac." This includes businesses, organisations, and individuals who may seek to use the term for marketing, branding, or event naming purposes. The regulations are designed to protect the sanctity of the term "Anzac," which holds significant historical and cultural importance in Australia, particularly in commemorating the service and sacrifice of Australian and New Zealand soldiers. The scope of the regulations extends across the Commonwealth, ensuring a consistent approach to the protection of the term "Anzac" regardless of state or territory boundaries. There is an exemption for the use of "Anzac Day" in the context of entertainments held on 25 April or over consecutive days that include that date, provided the term is not used to describe or designate individual events within a broader entertainment program.
Key Provisions
The statutory rules under the War Precautions Act Repeal Act 1920, specifically the Protection of Word “Anzac” Regulations, have been amended by the insertion of a new sub-regulation (1A) and the amendment of sub-regulation (2). Regulation 2 of the Protection of Word “Anzac” Regulations is modified to allow the use of the term "Anzac Day" in connection with an entertainment held on 25 April or on consecutive days that include 25 April, provided that these words are not used to describe or designate individual events within a multi-event entertainment. This amendment seeks to provide clarity and exceptions to the existing prohibition on the use of "Anzac" in trade and commerce while still preserving the sanctity of the term in appropriate contexts.
Under these regulations, the primary obligation imposed on parties is to refrain from using the term "Anzac" in a manner that could trivialise or commercialise its significance. However, the amendment allows for the use of "Anzac Day" when it is associated with commemorations held on 25 April or around it, as long as the term does not designate specific events within a larger entertainment. This balance aims to respect the solemnity of Anzac Day while permitting its appropriate use in connection with commemorative activities.
Failure to comply with these regulations could result in legal repercussions. The exact nature and severity of penalties are not specified within the text, but breaches of regulations under the War Precautions Act Repeal Act 1920 could potentially lead to civil or criminal consequences. Typically, penalties might include fines or other sanctions, depending on the specific nature and intent of the breach. The primary goal of these penalties is to enforce the respectful use of the term "Anzac" and to ensure its association remains dignified and appropriate for the solemn occasions it represents.
