National Offshore Petroleum Safety and Environmental Management Authority

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a regulatory framework for the safe and environmentally responsible exploration, production, and storage of petroleum and greenhouse gas in Australian waters. This Act addresses the problem of ensuring that offshore petroleum operations do not pose undue risks to human health, safety, or the environment. The Act was passed by the Commonwealth Parliament with the objective of establishing a robust regime for the safety and environmental management of offshore petroleum activities. The legislation empowers the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) to enforce compliance with safety standards and to take action to prevent and mitigate risks associated with offshore petroleum operations. Under the authority conferred by the Act, NOPSEMA has issued a notice prohibiting unauthorised vessels from entering a designated petroleum safety zone. This specific notice, issued by Stephen D'Souza on behalf of NOPSEMA, restricts the entry of vessels into a safety zone surrounding particular wells, effectively safeguarding the operations conducted by Sinopec Oil and Gas Australia (Puffin) Pty Ltd. The prohibition is in place from 2 September 2014 to 28 November 2014, within a radius of 500 metres from the specified well locations. The enforcement of this prohibition is aimed at preventing unauthorised activities that could compromise the safety and integrity of the offshore petroleum operations.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to entities and individuals involved in offshore petroleum activities and greenhouse gas storage within the Commonwealth of Australia. This Act regulates the safety and environmental management of offshore petroleum and greenhouse gas storage operations, ensuring compliance with stringent safety standards and environmental protection measures. The Act applies to all offshore petroleum activities and greenhouse gas storage projects, including exploration, production, and transportation, and it governs the activities of operators, licensees, and other relevant parties. The Act’s jurisdictional reach extends across the Commonwealth of Australia, covering both territorial waters and the Australian Exclusive Economic Zone. It provides the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) with the authority to issue notices, such as the prohibition of entry into a petroleum safety zone, to enforce compliance with safety regulations. The geographic scope of this specific notice pertains to a defined petroleum safety zone surrounding specified wells, extending 500 metres from each point of the outer edge of the wells Puffin-5, Puffin-9, Puffin-10, Puffin-11, and Puffin-12, with coordinates provided in GDA94. The notice, issued under section 616 of the Act, restricts entry into this safety zone to vessels under the control of Sinopec Oil and Gas Australia (Puffin) Pty Ltd, and vessels operated by authorised persons exercising powers under section 615(1) of the Act. All other vessels are prohibited from entering or being present in the safety zone without written consent from NOPSEMA. The notice is in effect from 2 September 2014 to 28 November 2014, and unauthorised entry into the safety zone is subject to penalties including imprisonment, the severity of which depends on the nature of the breach.

Key Provisions

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the "Act") includes several key provisions relevant to the regulation of petroleum activities and environmental safety in Australia's offshore areas. Section 616 (subsections 616(1) and 616(2)) empowers the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) to prohibit vessels from entering designated petroleum safety zones. This legislative power is exercised through the issuance of notices, such as the one issued on 28 August 2014 by Stephen D'Souza, an authorised representative of NOPSEMA. The specific notice restricts entry into a petroleum safety zone extending 500 metres from specific well points, identified by their coordinates, within a defined timeframe. The notice allows entry only for vessels under the control of Sinopec Oil and Gas Australia (Puffin) Pty Ltd, and those operated by authorised persons exercising specific powers under section 615(1) of the Act. The Act imposes strict obligations on vessels and their operators to comply with the prohibitions outlined in such notices. Vessels must not enter or remain within the specified safety zones without explicit written consent from NOPSEMA. The obligations extend to the vessel's owner and the person in command or in charge, who are each accountable for ensuring compliance with the notice. Failure to adhere to these requirements can result in significant legal consequences. The Act also delineates specific offences and associated penalties for breaches of its provisions. Under Section 616, any unauthorised vessel entering or remaining in the designated safety zone commits an offence. The penalties for such breaches vary based on the level of fault: imprisonment for up to 15 years if the breach is intentional, up to 12.5 years if reckless, up to 10 years if negligent, and up to 5 years if the breach is an offence of strict liability. These severe penalties underscore the importance of strict compliance with the Act and the notices issued under its authority. The notice in question explicitly states that the prohibition is effective from 2 September 2014 to 28 November 2014, highlighting the temporary nature of the restriction and the necessity for adherence during this period.
