Overview
The Australian National University Programs and Awards Statute 2013 was enacted to provide a legislative framework governing the admission, enrolment, assessment, and completion requirements of students within the university's academic programs, as well as the granting of academic awards. This Statute was established under the authority of the Australian National University Act 1991, section 50, aiming to streamline and formalise the processes surrounding academic program administration. The Statute was deliberated and approved by the Council of the University during its meeting on 15 February 2013 and came into effect on the same day, as permitted by the Legislative Instruments Act 2003. The enactment of this Statute was intended to ensure that the university's governance structure is robust and transparent, thereby protecting the rights and interests of all stakeholders involved.
Scope and Application
The Australian National University Programs and Awards Statute 2013 applies to students, prospective students, academic staff, and administrative personnel involved in the admission, enrolment, assessment, and graduation processes of the Australian National University (ANU). This statute serves as a foundational legislative instrument that governs the academic operations within ANU, ensuring that all programs and awards are conducted in accordance with the university's established standards and requirements. The statute is rooted in the Australian National University Act 1991 and operates within the jurisdiction of the Commonwealth of Australia. It delineates the authority for the creation of Rules and Orders that regulate student admission, enrolment, assessment, program completion, and the conferring of academic awards. The statute does not incorporate any other documents by reference and was subject to a consultation process that included consideration by the University Council on 15 February 2013. The University Council determined that the statute would commence on the day of its making, 15 February 2013, under the legislative instruments act 2003. The University maintains that the retrospective effect of this commencement does not adversely affect or disadvantage any individuals covered by the statute's provisions. The application of the statute may be extended or modified through subordinate instruments, which are to be developed in accordance with the statute's overarching objectives and principles.
Key Provisions
The Australian National University Programs and Awards Statute 2013 (the Statute) plays a pivotal role in governing the academic structure of the Australian National University (ANU). It outlines the framework for the creation of rules and orders concerning student admission, enrolment, assessment, program completion requirements, and the granting of academic awards. Section 1 of the Statute establishes the authority under which it is made, referencing the Australian National University Act 1991, section 50. This provision ensures that the Statute is legally binding and operates within the established legislative framework of ANU.
The Statute imposes specific obligations on ANU and its students. For instance, Section 2 mandates the creation of detailed rules and orders that must be followed for the admission and enrolment of students. Section 3 outlines the assessment criteria and processes that students must meet to complete their academic programs successfully. Furthermore, Section 4 details the requirements for the conferral of academic awards, ensuring that all students meet the necessary academic standards before being awarded a degree or diploma. These provisions ensure that the academic processes at ANU are transparent, consistent, and fair.
Breaches of the provisions set out in the Statute can lead to various consequences. While the Statute itself does not explicitly detail offences, penalties, or consequences for breach, the overarching Australian National University Act 1991 provides a framework for disciplinary actions against students who do not comply with the rules and orders. These actions can include warnings, suspensions, or expulsion from the University. Additionally, any failure to meet the academic requirements as stipulated in the Statute can result in the withholding of academic awards. The specific penalties and consequences would be determined in accordance with the broader governance and disciplinary policies of ANU, ensuring that all parties are held accountable within the academic framework.
