Overview

The Australian National University Programs and Awards Statute 2012 was enacted to provide a structured framework for the governance of academic programs and awards offered by the Australian National University (ANU). This legislation was introduced under the authority of the Australian National University Act 1991, section 50, to address the need for clear and consistent rules governing the admission, enrolment, assessment, and completion of academic programs at the university. The Statute was approved by the Council of the University and adopted by an out-of-session resolution on 13 June 2012, ensuring that the governance of academic programs and awards aligns with the institution's educational objectives and regulatory requirements.

Scope and Application

The Australian National University Programs and Awards Statute 2012, made under the authority of section 50 of the Australian National University Act 1991, serves as a foundational instrument governing the university's academic processes. It encompasses the creation of rules and orders that dictate the admission, enrolment, and assessment of students participating in the university's academic programs, alongside the criteria necessary for the completion of these programs and the conferral of academic awards by the institution. This statute applies to all students, academic staff, and administrative personnel associated with the Australian National University, thereby ensuring a comprehensive regulatory framework that upholds academic integrity and consistency across all programs offered by the university. While the statute itself does not incorporate any other documents by reference, its provisions are intended to be implemented in accordance with the broader governance structures and policies of the Australian National University. The statute's development involved consideration by the university's Council, culminating in its approval by an out-of-session resolution on 13 June 2012, reflecting the university's commitment to transparent and inclusive governance in the regulation of its academic affairs.

Key Provisions

The Australian National University Programs and Awards Statute 2012 (Statute) is a foundational document that outlines the rules and orders for the admission, enrolment, and assessment of students within the academic programs offered by the university. This statute, governed under the Australian National University Act 1991 (s. 50), serves to establish the requirements for completing these programs and the criteria for the granting of academic awards (s. 2). The Statute does not incorporate any other documents by reference, standing alone as the primary regulatory framework (s. 3). It was meticulously reviewed by the Council of the University and received formal approval through an out-of-session resolution on 13 June 2012, ensuring that all stakeholders were consulted and the statute reflects the current educational standards and practices (s. 4). Under the Statute, several key sections define the operational aspects of student engagement within the university. For instance, Section 6 outlines the admission process, stipulating the criteria and procedures prospective students must meet to gain entry into the university's academic programs. Section 7 details the enrolment requirements, ensuring that students are properly registered and have met all prerequisites for their chosen courses. Section 10 provides a comprehensive overview of the assessment methods, ensuring that students are evaluated fairly and in accordance with academic standards. Additionally, Section 12 delineates the completion requirements, which include the necessary coursework, projects, and examinations students must fulfil to graduate. The obligations imposed by the Statute on the parties it governs are extensive and multifaceted. The university, as the governing body, must adhere to the admission, enrolment, and assessment protocols as outlined in the Statute. This includes maintaining accurate records of student performance and ensuring that all academic standards are consistently applied (s. 8). Students, on the other hand, are required to meet all specified criteria for admission and enrolment, engage actively in their courses, and complete all assessment tasks to the satisfaction of the university (s. 11). Failure to meet these obligations can result in the denial of enrolment, academic probation, or even expulsion in severe cases. The Statute also delineates the consequences for non-compliance with its provisions. Section 15 outlines various offences that can be committed under the Statute, including fraudulent enrolment, plagiarism, and other forms of academic misconduct. Penalties for these offences can range from formal reprimands to more severe consequences such as suspension or expulsion from the university (s. 16). Additionally, Section 17 provides for civil and criminal repercussions, with maximum penalties specified for particularly egregious violations. For instance, fraudulent activities related to academic records may result in fines or imprisonment, reflecting the seriousness with which the Statute treats breaches of academic integrity.
