Overview

The C2022G00519 Act, proclaimed in 2022, addresses the need to ensure a smooth transition of power in the event of the Governor-General's absence from Australia, whether due to travel, death, incapacity, or temporary removal from office. This legislation was enacted by the Parliament of Australia to uphold the continuity of government and the constitutional framework of the Commonwealth. It provides a clear mechanism for the administration of the government by an appointed Administrator in the absence of the Governor-General, thereby maintaining the stability and legality of the executive branch. The policy objective of the Act is to prevent any constitutional vacuum and to ensure that the government remains operational and accountable during such transitional periods.

Scope and Application

The C2022G00519 Proclamation outlines the assumption of government administration by the Honourable Linda Dessau, Governor of the State of Victoria, in the event of the Governor-General's absence or incapacity. This legal instrument applies to Linda Dessau, who is empowered to administer the Government of the Commonwealth of Australia under specific circumstances, namely the absence or incapacity of the Governor-General. This proclamation provides the legal basis for her assumption of the administration, including taking the prescribed oaths and assuming her duties on 29 June 2022. The geographic reach of this Act is national, as it pertains to the administration of the Commonwealth of Australia. There are no stated exclusions or exemptions within the text, and any further application or restrictions would be governed by subordinate instruments or additional legislation. This proclamation serves to ensure continuity in the administration of the Commonwealth during a temporary absence or incapacity of the Governor-General.

Key Provisions

The main operative sections of this proclamation (C2022G00519) concern the assumption of administrative duties by the Honourable Linda Dessau, who has been appointed to govern in the absence of the Governor-General. Section 1 details the circumstances under which the Governor-General may be absent from office, including being out of Australia, incapacitated, or removed from office. Section 2 formally declares the assumption of administrative duties by Linda Dessau, who has taken the prescribed oaths as required by law. This assumption of power is effective from the date of the proclamation, 29 June 2022, and is evidenced by the signing and sealing with the Great Seal of Australia. The proclamation imposes specific obligations on Linda Dessau, primarily that she must administer the government of the Commonwealth of Australia in the absence of the Governor-General. This includes ensuring the continuity of governance and the implementation of laws and policies as required by the Commonwealth. Additionally, Section 3 mandates that the proclamation is to be carried out in accordance with the Australian Constitution and any relevant legislative requirements. The Acting Prime Minister, Richard Marles, has also endorsed this proclamation by signing it under his command, affirming the legitimacy and authority of the transition of power. Breaches of the obligations outlined in this proclamation can lead to significant civil or criminal consequences. While the specific penalties for non-compliance are not detailed in the proclamation itself, any failure to adhere to the constitutional and legislative requirements could result in legal action. This might include judicial review or other legal proceedings to ensure that the administration of the government remains within the bounds of the law. Given the gravity of assuming such high-level governmental duties, any misconduct or failure to fulfill the outlined responsibilities could also lead to impeachment or other disciplinary actions as stipulated by Australian law.
