Overview

The Administrator of the Government of the Commonwealth of Australia Act 2022 was enacted to address the potential for a situation in which the Governor-General is unable to perform their duties, such as when they are absent from Australia. The Act provides for the appointment of an Administrator who can assume the responsibilities of the Governor-General during such times. This legislation was enacted by the Parliament of Australia and its primary policy objective is to ensure continuity of government in the absence of the Governor-General, thereby maintaining the smooth operation of the federal executive. The Act facilitates the orderly transition of power and provides a clear framework for the administration of the government in extraordinary circumstances.

Scope and Application

The proclamation described in the legislation, C2022G00344, pertains specifically to the temporary assumption of governmental duties by the Honourable Linda Dessau, who is the Governor of the State of Victoria. This Act applies directly to Linda Dessau as she assumes the role of Administrator of the Government of the Commonwealth of Australia due to the Governor-General’s absence out of Australia. The proclamation outlines the legal and constitutional basis for her appointment, detailing the circumstances under which she has taken on these responsibilities, including the Governor-General's absence out of Australia or other specified contingencies. The jurisdictional reach of this Act is confined to the Commonwealth of Australia, impacting the federal governance structure during the temporary absence of the Governor-General. No exclusions, exemptions, or thresholds are explicitly stated within the text of the proclamation itself, though any further application or restrictions would be detailed in subordinate instruments or related legislation.

Key Provisions

The primary operative sections of the proclamation (sections 2 and 3) establish the circumstances under which the Governor of the State of Victoria, in this instance the Honourable Linda Dessau, assumes the administration of the Government of the Commonwealth of Australia. According to section 2, the Governor is appointed by Her Majesty Queen Elizabeth the Second, through a Commission under Her Royal Sign Manual and the Great Seal of Australia, to administer the Government in specified events such as the Governor-General's absence out of Australia, death, incapacity, removal, or temporary absence from office. Section 3 then declares that, following the prescribed oaths, the Governor assumes the administration of the Government when the Governor-General is absent out of Australia. These sections are essential as they provide the legal basis for the transition of power and ensure the continuity of government. The obligations and requirements imposed by this Act are primarily procedural. The Governor, upon assuming the administration of the Government, must take the prescribed oaths as stipulated in section 2. This procedural step is crucial to validate the legitimacy of the assumption of power. Additionally, the proclamation must be signed and sealed with the Great Seal of Australia, which is evidenced in section 3, to authenticate the document and provide official recognition of the Governor’s new role. There are no specific offences, penalties, or consequences outlined in this proclamation for breach of its provisions. However, the significance of the procedural requirements underscores the importance of strict adherence to the prescribed processes. Any failure to comply with the oath-taking or the formal signing and sealing could potentially question the validity of the administration, leading to legal and constitutional complications. Nonetheless, the document itself does not explicitly state penalties for non-compliance, focusing instead on the formal declaration and assumption of duties.
