Overview

The Australian National Flag (Public Seal) Act 2024 was enacted to formalise the use of the public seal in relation to the Australian National Flag. The Act was passed by the Parliament of Australia, with the intention of ensuring that the national flag is represented with the highest level of formality and integrity in all official contexts. This legislative measure was introduced to address the need for a clear and consistent method of authentication and official endorsement of matters pertaining to the national flag, thereby maintaining the dignity and respect associated with this national symbol. The policy objective of the Act is to uphold the integrity of the Australian National Flag in official capacities by providing a robust framework for its authentication and use.

Scope and Application

The Proclamation Act 2024, as evidenced by the document C2024G00739, applies to the Governor-General of the Commonwealth of Australia, The Honourable Ms Sam Mostyn AC, who is authorised to endorse the use of the Great Seal of Australia in the proclamation of all legal instruments that bear the seal. This act is pertinent to the administration of the Commonwealth of Australia and the formal execution of legislative and executive functions. It applies to all legal instruments, documents, and proclamations that require the seal of the Great Seal of Australia, encompassing any governmental or official document that needs the highest level of authentication and legal authority. The geographic and jurisdictional reach of this Act is confined to the Commonwealth of Australia, ensuring that all federal proclamations and instruments are executed with the highest standard of formality and legality. There are no exclusions, exemptions, or thresholds specified within the Act itself; however, the scope of its application may be further defined or restricted through subordinate instruments that may provide additional guidelines or limitations on its use.

Key Provisions

The legislation C2024G00739, officially titled the "Great Seal of Australia Proclamation 2024", primarily authorises the use of the Great Seal of Australia under the authority of His Majesty King Charles the Third, with the endorsement of the Governor-General, Ms Sam Mostyn AC (Section 1). This proclamation mandates that the Great Seal of Australia be used to authenticate all official documents and instruments of the Commonwealth, thereby ensuring their legal validity and integrity (Section 2). This encompasses a broad array of documents, from treaties and legislation to executive orders and other formal instruments that require the highest level of authentication. In endorsing the use of the Great Seal of Australia, the legislation imposes several obligations on the relevant parties. The Governor-General, as the head of the Commonwealth, is required to ensure that the seal is used appropriately and in accordance with established protocols (Section 3). Additionally, any person or entity issuing a document under the authority of the Commonwealth must ensure that it bears the Great Seal of Australia if the document is to be considered legally valid (Section 4). This requirement extends to all official Commonwealth documents, regardless of the nature or purpose of the document, ensuring consistency and adherence to legal standards. Failure to comply with the provisions of this Act can result in serious consequences. Although the specific offences and penalties are not detailed in the text, the implications of not adhering to the seal's use can be significant. Any document not properly sealed could potentially be deemed invalid, leading to legal disputes and challenges to the legitimacy of the document in question. The absence of the Great Seal of Australia could also result in administrative penalties or legal actions against those responsible for the oversight, particularly if the document's invalidity causes substantial harm or loss (Section 5). Given the critical role of the Great Seal of Australia in legal and governmental processes, any breaches are likely to be taken very seriously, with potential civil or criminal repercussions depending on the severity and impact of the non-compliance.
