Overview
The Australian Government Administration Act 2015 was enacted to address the need for continuity and stability in the administration of the Australian Government in the event that the Governor-General is unable to perform their duties. The Act was passed by the Parliament of Australia, with the objective of ensuring that the administration of the Commonwealth remains uninterrupted during periods when the Governor-General is absent, incapacitated, or otherwise unable to serve. This legislation provides a clear framework for the assumption of governmental responsibilities by an appointed administrator, thereby safeguarding the continuity of governance and maintaining public confidence in the administration of the Commonwealth. The Act was brought into effect through a proclamation by the then Governor of the State of Queensland, the Honourable Paul de Jersey, who assumed the administration of the Government of the Commonwealth of Australia on 1 August 2015 in accordance with the provisions of the Act.
Scope and Application
The proclamation and subsequent assumption of administrative duties by the Honourable Paul de Jersey, as outlined in C2015G01252 (Gazette), apply to the governance of the Commonwealth of Australia in the absence of the Governor-General. This applies to the constitutional and ceremonial duties of the office during the period of the Governor-General's absence, whether due to being out of Australia, incapacity, death, or any temporary absence from office. The proclamation underscores the constitutional mechanisms in place to ensure continuity of government and governance within the Commonwealth. The jurisdictional reach of this proclamation is confined to the federal level, impacting the operations and administrative functions of the Commonwealth government. There are no specific exclusions or exemptions mentioned within the text, though it is implied that the authority of the Administrator is limited to the period of the Governor-General's absence and does not extend beyond the scope of the Governor-General's duties as defined by law. This proclamation is a formal assertion of the continuity of government administration and does not extend its application through subordinate instruments but rather directly through the constitutional mandate it affirms.
Key Provisions
The Proclamation (section 4) sets out the circumstances under which the Governor of Queensland, in this case the Honourable Paul de Jersey, assumes the administration of the Government of the Commonwealth of Australia. This occurs when the Governor-General is absent out of Australia, incapacitated, removed from office, or temporarily absent from office. The Governor assumes this role upon taking the prescribed oaths, as evidenced by the document dated 1 August 2015. The document signifies the formal assumption of duties by the Governor in the absence of the Governor-General.
Under this legislation, the Governor of Queensland assumes significant responsibilities and duties typically carried out by the Governor-General. These duties include the administration of the Commonwealth government, ensuring the continuity of government, and performing any other functions that may be necessary during the absence or incapacity of the Governor-General. The Governor must adhere to the oaths prescribed by the Constitution and ensure that all governmental operations proceed smoothly in the absence of the Governor-General.
Breaching the provisions of this legislation could have serious legal consequences. While the document itself does not outline specific offences or penalties for non-compliance, the assumption of such a critical role without the prescribed oaths or outside the stipulated circumstances could lead to legal challenges. The legitimacy of actions taken by the Administrator may be questioned, potentially leading to judicial review or other legal actions. The seriousness of these potential consequences underscores the importance of adhering strictly to the prescribed procedures.
Furthermore, the document highlights the chain of command and the formal process by which the Governor assumes these duties. The signature and seal of the Administrator, along with the endorsement by the Prime Minister, Tony Abbott, reinforce the legal and constitutional basis for this assumption of power. This formal endorsement is crucial for the legitimacy of the Administrator's actions and helps to maintain the stability and continuity of the Commonwealth government during the absence of the Governor-General.
