Overview
The Administration of the Commonwealth Act 2018, enacted to address the specific scenario where the Governor-General is absent from Australia, the incapacity or removal of the Governor-General, or their temporary absence from office, was introduced to ensure continuity of government administration. This Act allows for the designation of an Administrator who can assume the role of administering the Government of the Commonwealth in the absence of the Governor-General. The Parliament of Australia established this legal framework to maintain the integrity and operation of the federal government without interruption, reflecting a policy objective of ensuring that the administration of the Commonwealth remains uninterrupted in extraordinary circumstances. The Act provides a clear process for the transition of power, ensuring that the governance of the nation remains stable and lawful even in the event of the Governor-General's unavailability.
Scope and Application
The C2018G00186 Proclamation, issued under the authority of the Australian Constitution, delineates the circumstances under which the Honourable Paul de Jersey assumed the role of Administrator of the Government of the Commonwealth of Australia. This specific proclamation applies to the period during which the Governor-General is absent from Australia, incapacitated, or otherwise unable to perform their duties, thereby necessitating the assumption of these responsibilities by the appointed Administrator. The geographic scope of this legislation is national, as it pertains to the entire Commonwealth of Australia, and is not confined to any particular state or territory. It is important to note that the application of this Act is triggered by the specific conditions outlined in the Proclamation and does not extend to other forms of governmental administration unless the stated conditions are met. The proclamation itself does not include detailed provisions on exclusions or exemptions, but rather it focuses on the formal assumption of duties by the Administrator in the outlined exceptional circumstances.
Key Provisions
The primary sections of the Proclamation (C2018G00186) include the invocation of the powers under which the Honourable Paul de Jersey, as Governor of the State of Queensland, assumes the administration of the Government of the Commonwealth of Australia. Section 2 of the Proclamation outlines the appointment by Her Majesty Queen Elizabeth II, through a Commission dated 6 September 2014. It details the circumstances under which the Governor of a State can assume the administration of the Commonwealth Government, specifically in the absence of the Governor-General, whether due to absence out of Australia, death, incapacity, removal, or temporary absence for any reason. The Proclamation itself (Section 3) formally declares that Paul de Jersey has assumed this administration role, following the taking of the prescribed oaths, effective from 10 March 2018.
Under this legislation, Paul de Jersey, as the appointed Governor of Queensland, is required to administer the Government of the Commonwealth until the Governor-General returns or is otherwise able to resume their duties. This involves managing the day-to-day operations of the Government and ensuring continuity in governance. The Administrator must act in accordance with the Constitution and any other applicable laws, maintaining the integrity and stability of the Commonwealth Government during this interim period.
The Proclamation also sets out the obligations of the Administrator, which include performing all the functions and duties of the Governor-General. This encompasses the ceremonial, administrative, and constitutional responsibilities typically associated with the office of the Governor-General. The Administrator must ensure that the government functions smoothly and that the public is informed of the temporary change in leadership. Additionally, the Administrator is required to adhere to the oaths and declarations stipulated in the Commission, ensuring a lawful and legitimate transfer of power.
Failure to comply with the provisions of this Proclamation could lead to legal consequences. Although the specific penalties are not detailed in the text, breaches of constitutional duties and obligations typically result in significant legal repercussions. The consequences could range from administrative penalties to potential criminal charges, depending on the severity of the breach. In extreme cases, where the Administrator's actions are deemed to undermine the governance or stability of the Commonwealth, there could be implications for their position and reputation, alongside any applicable legal sanctions.
