Overview
The Proclamation C2018G00066, dated 30 January 2018, was enacted to address the absence of the Governor-General from Australia, ensuring a seamless transition of power and administration of the Government of the Commonwealth of Australia. The Governor of the State of Queensland, the Honourable Paul de Jersey, was appointed as the Administrator under the Commission dated 6 September 2014. The enacting body in this instance is the Governor of Queensland, who assumed the administration of the Government in accordance with the constitutional provisions that allow for such an occurrence. The policy objective is to maintain continuity of governance and uphold the constitutional framework during the temporary absence of the Governor-General.
Scope and Application
The proclamation in C2018G00066, dated 30 January 2018, designates the Honourable Paul de Jersey as the Administrator of the Government of the Commonwealth of Australia during the absence of the Governor-General, either temporarily or due to circumstances such as being out of Australia, incapacity, or removal from office. This applies to the Commonwealth level and involves the administration of government affairs in the interim period. The proclamation does not specify particular persons, entities, industries, conduct, or transactions directly affected by this administrative transition, but it implies that it pertains to the entire governance apparatus of the Commonwealth. The jurisdictional reach of this Act is national, as it concerns the highest office of the Commonwealth. There are no stated exclusions, exemptions, or thresholds within the text, and the proclamation itself does not extend or restrict its application through subordinate instruments. Instead, it serves as a formal legal instrument to ensure continuity in the administration of government affairs during the absence of the Governor-General.
Key Provisions
The main operative sections of the Proclamation C2018G00066 (Gazette) provide for the assumption of the administration of the Government of the Commonwealth of Australia by the Honourable Paul de Jersey, in the event of the Governor-General's absence from Australia. Specifically, section 2 of the Proclamation outlines the circumstances under which the Administrator takes over, and section 3 details the oaths that the Administrator must take before assuming office. The proclamation is clear in its assertion that Paul de Jersey, having taken the prescribed oaths, has assumed the administration of the Government of the Commonwealth of Australia as of 30 January 2018.
The Act imposes specific obligations on the Administrator upon assuming office. Section 2 requires the Administrator to take the prescribed oaths as stipulated by law, ensuring the continuity of government administration and adherence to constitutional requirements. Furthermore, section 3 mandates that the Administrator's assumption of office be officially proclaimed, which has been duly executed with the signing and sealing of the Proclamation by Paul de Jersey himself. This formality ensures that the transition of power is transparent and legally sound.
In terms of offences and consequences, the Act does not explicitly enumerate specific breaches or penalties. However, the importance of the oaths and the solemnity of the proclamation imply that any failure to comply with the required formalities could have significant legal and constitutional repercussions. While the Act does not detail specific penalties, breaches of constitutional duties or failure to uphold the prescribed processes could potentially lead to legal challenges or actions under other relevant legislations. The gravity of the Administrator's role necessitates strict adherence to the procedures outlined in the Act.
