Overview
The Administration of the Commonwealth Act 2014, enacted in 2014, addresses the contingency of the absence, death, incapacity, or removal of the Governor-General of Australia. This Act was passed by the Parliament of Australia to ensure a smooth transition of the administration of the Commonwealth government in situations where the Governor-General is unable to fulfil their duties. The policy objective of the Act is to maintain continuity and stability in the governance of Australia by providing a clear framework for the administration of the Commonwealth during periods of vacancy or incapacity of the Governor-General. The Act allows for the appointment of an Administrator to assume the responsibilities of the Governor-General, as demonstrated by the proclamation of the Honourable Paul de Jersey as Administrator on 11 July 2016 due to the Governor-General's absence from Australia.
Scope and Application
This proclamation establishes the assumption of governmental administration by the Honourable Paul de Jersey, who is appointed as the Administrator of the Government of the Commonwealth of Australia in the absence of the Governor-General. The proclamation, which is under the authority of the Commission dated 6 September 2014, delineates the circumstances under which this assumption of power occurs, specifically when the Governor-General is absent from Australia, incapacitated, removed from office, or temporarily absent for any reason. The proclamation is legally binding and effective from 11 July 2016, and it is signed and sealed with the Great Seal of Australia by Paul de Jersey, who has taken the prescribed oaths as required by the Act. The geographic reach of this proclamation is national, applying to the entire Commonwealth of Australia, and it is implemented under the command of the Prime Minister, Malcolm Turnbull. This proclamation serves to ensure the continuity of government administration during periods of the Governor-General's absence or incapacity.
Key Provisions
The proclamation (section 2) outlines the process by which the Honourable Paul de Jersey, Governor of the State of Queensland, assumed the administration of the Government of the Commonwealth of Australia due to the absence of the Governor-General. The Governor-General’s absence out of Australia triggers this assumption of duties, as specified by the Commission dated 6 September 2014. This assumes effect from 11 July 2016, following the prescribed oaths being taken by the Administrator.
The Act imposes several obligations on the Administrator, primarily ensuring the continuity of government and the administration of the Commonwealth. These include the execution of the powers and duties of the Governor-General while the latter is absent (section 3). The Administrator is tasked with maintaining the stability and functionality of the government, which includes making necessary decisions and performing official duties in the absence of the Governor-General.
In terms of offences and penalties, the legislation does not explicitly outline specific criminal or civil consequences for breaches within its scope. However, any actions taken by the Administrator outside the scope of the Commission or in disregard of constitutional protocols could potentially lead to legal scrutiny and accountability under broader constitutional and administrative law principles. The potential penalties for such breaches would depend on the specific nature of the misconduct and the legal framework applicable at the time.
Overall, the proclamation and subsequent administration by the Administrator are designed to ensure that the governance of the Commonwealth continues smoothly in the absence of the Governor-General. The legal framework ensures that the duties of the highest office are seamlessly transferred, preserving the integrity and continuity of the Australian government.
