Overview
The Administration of the Commonwealth of Australia Act 2016 was enacted in 2016, establishing procedures for the administration of the Commonwealth Government in the absence of the Governor-General. This Act was introduced to address the problem of potential governance gaps in the absence of the Governor-General, who is typically the representative of the Crown in the administration of the Commonwealth of Australia. The Act provides a clear framework for the interim administration of the Government, ensuring continuity and stability in the event of the Governor-General's absence out of Australia, death, incapacity, removal, or temporary absence from office. The policy objective of this Act is to maintain the effective functioning of the Commonwealth Government without interruption.
The Act was passed by the Parliament of the Commonwealth of Australia, reflecting the need for a formal legislative basis to address these circumstances. By establishing the process through which an Administrator can assume the administration of the Government, the Act ensures that there is no legal vacuum and that the continuity of government is preserved, thereby safeguarding the nation's interests and maintaining public confidence in the administration of the Commonwealth.
Scope and Application
The C2016G00789 Proclamation pertains to the administration of the Government of the Commonwealth of Australia in the event of the absence or incapacity of the Governor-General. It applies to the Commonwealth of Australia, encompassing all entities and persons within its jurisdiction. Specifically, it grants authority to the Honourable Paul de Jersey to assume the administration of the government in the absence of the Governor-General. This encompasses all roles, functions, and responsibilities typically undertaken by the Governor-General, ensuring continuity of governance. The proclamation extends to all matters within the Commonwealth's jurisdiction and is not restricted to specific geographic areas or industries, though its primary application is governmental. There are no stated exclusions or exemptions within the scope of this proclamation; it applies comprehensively to the governance of the Commonwealth. Subordinate instruments may further define specific roles and responsibilities during the administration period, but the primary legislation itself is clear and direct in its purpose and application.
Key Provisions
This proclamation outlines the legal process by which the Honourable Paul de Jersey assumed the administration of the Government of the Commonwealth of Australia on 7 June 2016 (section 4). It is founded on the authority provided by the Commission dated 6 September 2014, under which Queen Elizabeth the Second appointed Paul de Jersey as the Governor of the State of Queensland, tasked with administering the Government in the absence of the Governor-General (section 2). The key operative section, section 4, specifies the circumstances under which the Administrator takes office, namely when the Governor-General is absent out of Australia, incapacitated, or otherwise unable to perform their duties.
The Act imposes specific obligations on Paul de Jersey as the Administrator. He must take the prescribed oaths and assume the duties of the Governor-General as outlined in the Constitution and other relevant laws (section 4). The proclamation mandates that he administer the Government in accordance with the laws of the Commonwealth of Australia, ensuring continuity and stability in the governance of the country during the Governor-General's absence (section 4). His responsibilities include the formal and ceremonial duties typically performed by the Governor-General, as well as any other functions that may arise during this period of administration.
Should there be any breach of the duties or responsibilities outlined in the proclamation, the Administrator may face civil or criminal consequences. Although the specific penalties are not detailed in this proclamation, breaches of such a nature could lead to legal actions under the common law or other statutory provisions, potentially resulting in penalties commensurate with the severity of the breach. The exact penalties would depend on the nature of the breach and would be determined by the relevant courts or tribunals in accordance with Australian law.
