Overview
The C2018G00129 Proclamation, issued in 2018, addresses the need for a clear and formal mechanism to ensure the continuity of government in the absence of the Governor-General. Enacted by the Parliament of Australia, this proclamation was necessitated by the temporary absence of the Governor-General from Australia. The fundamental policy objective of this Act is to maintain the constitutional stability and governmental functions without interruption. It provides for the appointment of an Administrator to temporarily assume the duties and responsibilities of the Governor-General during their absence, ensuring that the administration of the Commonwealth continues seamlessly. This legislative measure is crucial for upholding the rule of law and the effective operation of the government, reflecting the constitutional framework designed to manage such contingencies.
Scope and Application
The Proclamation C2018G00129 governs the administration of the Government of the Commonwealth of Australia in the absence of the Governor-General. This includes situations where the Governor-General is absent out of Australia, incapacitated, or temporarily absent for any reason. This Act applies to the Administrator who assumes the role of the Governor-General during these periods, thereby ensuring the continuity of government. The proclamation is binding within the Commonwealth of Australia and takes effect immediately upon the Governor-General’s absence. It does not specify exclusions or exemptions but relies on the inherent authority of the Administrator to act in place of the Governor-General. The proclamation’s scope is limited to the specific event of the Governor-General’s absence and does not extend beyond the circumstances described. The Administrator’s authority is derived directly from the proclamation and does not require additional legislative instruments to define its application.
Key Provisions
The primary operative sections of this proclamation pertain to the assumption of the administration of the Government of the Commonwealth of Australia by the Honourable Linda Dessau (sections 1-3). This is triggered by the Governor-General’s absence out of Australia, leading to the appointment of an Administrator to temporarily take over the functions of the Governor-General. This proclamation confirms the legal transition of power from the Governor-General to the Administrator, in this case, Linda Dessau, who has taken the prescribed oaths and assumed her duties.
The Act imposes several obligations on the parties involved. Firstly, the Administrator must fulfill all the duties and responsibilities of the Governor-General in their absence, ensuring the continuity of government and the implementation of laws and policies (section 4). This includes the execution of executive powers and the maintenance of constitutional duties, ensuring the government operates smoothly without interruption. Additionally, the proclamation binds the Administrator to adhere strictly to the oaths taken, which include allegiance to the Crown and the execution of the office in accordance with the Constitution.
In the event of a breach of any obligations or duties outlined in the Act, there are specified legal consequences. While the proclamation itself does not explicitly detail penalties for non-compliance, breaches of oath or dereliction of duty could potentially lead to legal actions under existing laws pertaining to public officials. Such actions could result in removal from office, civil penalties, or even criminal charges depending on the severity of the breach. The maximum penalties would be determined by the relevant statutes governing the conduct of public officials, but they could include fines and imprisonment for serious offenses.
The proclamation underscores the importance of maintaining constitutional governance and the continuity of the executive branch, even in the absence of the Governor-General. It ensures that the administration of the Commonwealth of Australia remains uninterrupted and that the rule of law is upheld. The assumption of duties by the Administrator is a critical mechanism to prevent any power vacuum and to ensure that the government can continue to function effectively.
