Overview

The Primary Producers Relief Regulations 1938 were enacted under the States Grants (Fertilizer) Act 1937 to provide financial relief to primary producers in the form of payments for the use of artificial manure in the production of primary produce other than wheat. These regulations were made by the Governor-General-in-Council, with the aim to support primary producers during a time of economic difficulty by offering compensation for the use of artificial fertilizers. The policy objective was to alleviate some financial burdens on primary producers, thereby encouraging the continued use of fertilizers to maintain agricultural productivity. These regulations specify the forms and procedures for applying for certificates and payments, and outline the requirements for declarations and certifications to ensure the legitimacy of claims.

Scope and Application

The Primary Producers Relief Regulations 1938 apply to primary producers and states within Australia, providing relief for those using artificial manure in the production of primary produce other than wheat during the specified period. These regulations are subordinate instruments made under the States Grants (Fertilizer) Act 1937 and govern the application process for obtaining certificates and payments from the Department of Commerce. The Act applies to primary producers, defined as individuals or entities engaged in the production of primary produce, and to states which may also apply for payments on behalf of primary producers. The regulations detail the forms and procedures for applications, including declarations and certificates, and specify the types of artificial manure eligible for the relief, excluding animal or vegetable matter, agricultural lime, or products primarily for supplying lime. Applications must be made to the appropriate department in each state or territory, and are subject to penalties for false or misleading statements. The scope of the regulations is confined to the use of artificial manure during the financial year ending June 30, 1938, with a cap of 20 tons per primary producer.

Key Provisions

The Primary Producers Relief Regulations 1938, made under the States Grants (Fertilizer) Act 1937, provide detailed guidance on how primary producers, States, and approved organizations can apply for and obtain relief payments related to the use or supply of artificial manure. Section 3 requires primary producers to submit an application for a certificate of use of artificial manure, supported by a declaration and a supplier's certificate, in accordance with Form A. Section 4 mandates that the certificate itself must be in accordance with Form B. Section 5 stipulates that primary producers must apply for payment using Form C, again supported by a declaration and a supplier's certificate. Section 6 outlines the requirements for State applications, which must be made by the Permanent Head of the relevant Department and in accordance with Form D. Section 7 details the process for approved organizations to apply for a certificate of supply of artificial manure, which must be completed in accordance with Form E and supported by a declaration. These Regulations impose several obligations on the parties involved. Primary producers must accurately report the use of artificial manure and provide detailed information about the quantities and sources of the manure used. Suppliers of artificial manure are required to certify the details of their sales to primary producers. States and approved organizations must similarly provide precise details of the artificial manure used or supplied by them, respectively, for the purposes of the grant. All declarations must be made before an authorized person, and applications must be submitted to the Secretary of the Department of Commerce at the specified address for the relevant State or Territory. Breach of the provisions of the States Grants (Fertilizer) Act 1937, including the making of false or misleading statements or presenting false documents, carries significant penalties. Under the Act, an individual can be fined up to £500 or imprisoned for up to two years for each offence. These penalties underscore the importance of accuracy and honesty in the application process, ensuring that relief payments are made fairly and to those who genuinely qualify under the terms of the Act.
