Overview

The Statutory Rules 1937 No. 84, made under the Financial Relief Acts 1936, represents a legislative instrument designed to amend the Primary Producers Relief Regulations 1937. Enacted in 1937 by the Deputy of the Governor-General in accordance with the advice of the Federal Executive Council, these regulations aim to address specific administrative and procedural aspects of financial relief provided to primary producers during a period of economic distress. The underlying objective of these amendments is to refine the process of documenting and verifying the purchase of artificial manure by primary producers, ensuring that the financial aid mechanisms are accurately and effectively implemented. This regulatory amendment underscores the Commonwealth Government's commitment to supporting primary producers through precise and reliable administrative practices.

Scope and Application

This Statutory Rule, made under the Financial Relief Acts 1936, pertains specifically to the amendment of the Primary Producers Relief Regulations 1937. The regulation applies to primary producers who are engaged in the purchase or obtaining of artificial manure, as detailed in Form A of the Primary Producers Relief Regulations. This encompasses individuals and entities involved in the agricultural sector, particularly those who are directly procuring artificial manure for their operations. The amendment is focused on ensuring accurate documentation and transparency in the procurement process, with a particular emphasis on specifying the source, type, and quantity of the artificial manure purchased or obtained. The regulation's application is confined to the Commonwealth of Australia, thereby extending its jurisdictional reach across the entire nation. There are no specific exclusions, exemptions, or thresholds mentioned within the text of the Statutory Rule itself, though the scope of its application may be further defined through subordinate instruments or additional regulations under the Financial Relief Acts 1936.

Key Provisions

The main operative section of this legislation is the amendment of Form A within the Primary Producers Relief Regulations 1937 (section 2). This amendment involves the replacement of paragraph 2 with a new version, which requires the individual to specify details about the artificial manure they have purchased or obtained. The new paragraph mandates the inclusion of the supplier's name, address, the kind and brand of the artificial manure, and the quantity purchased or obtained, measured in tons, hundredweight, quarters, and pounds. Under this Act, parties or entities governed by the Primary Producers Relief Regulations 1937 must adhere to the updated requirements when completing Form A. Specifically, they must accurately provide details about the artificial manure, including the supplier's information and the quantity obtained. This ensures that the data collected is precise and useful for the purposes of the relief provided under the Act. Failure to comply with the requirements set out in the amended Form A may lead to civil or administrative consequences. While the exact penalties are not specified within this legislative instrument, non-compliance with regulatory requirements under the Primary Producers Relief Regulations 1937 could potentially result in fines or other enforcement actions as stipulated by the relevant legislation. It is important for parties to carefully follow the instructions and provide accurate information to avoid any adverse outcomes.
