Overview

The Primary Producers’ Relief (Artificial Manure) Regulations were enacted in 1934 as a legislative instrument under the Financial Relief Act 1934. These regulations were introduced to address the economic hardships faced by primary producers during the Great Depression. The regulations provide a framework for primary producers to apply for financial assistance for the use of artificial manure in the production of primary produce other than wheat. The enacting body responsible for these regulations was the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. The policy objective is to support primary producers by offering financial relief through the provision of certificates and claims for the use of artificial manure, ensuring that the assistance is accurately and honestly claimed.

Scope and Application

The Primary Producers’ Relief (Artificial Manure) Regulations, made under the Financial Relief Act 1934, apply to primary producers in the various states of Australia who wish to apply for a certificate or claim financial assistance in respect of the use of artificial manure for the production of primary produce other than wheat. These regulations specify the forms and declarations necessary for applications and claims, including the requirement for applications to be signed by the primary producer and supported by a declaration and a certificate from the supplier of the artificial manure. The regulations also provide for the authorization of certain individuals to sign certificates on behalf of suppliers. The application process must be completed and submitted to the Secretary of the Department of Commerce by 31 October 1935. These regulations cover the entire Commonwealth of Australia and pertain specifically to the financial relief provided for the use of artificial manure in primary production, with exclusions for certain types of manure that do not meet the specified criteria. The regulations are detailed in the forms provided in the Schedule, which outline the necessary documentation and information required for each application and claim.

Key Provisions

The Primary Producers’ Relief (Artificial Manure) Regulations (1934) outline the process and requirements for primary producers to apply for a certificate and financial assistance under the Financial Relief Act 1934. Section 3(1) requires that an application for a certificate by a primary producer must adhere to Form A, which must be accompanied by a declaration made by the applicant before a designated official and a certificate from the supplier of the artificial manure. Section 4 mandates that the certificate itself must comply with Form C. Additionally, section 5 stipulates that claims for financial assistance must be made on Form D, detailing the quantities of artificial manure used and the supplier’s information. These applications must also be supported by a declaration and a supplier’s certificate, as outlined in section 6. The Regulations impose several obligations on primary producers and suppliers. Primary producers must submit accurate and complete applications, including specific details about the artificial manure used and the primary produce it was applied to. They must also ensure that their applications are signed and accompanied by the necessary declarations and supplier certificates. Suppliers, on the other hand, are required to provide accurate certifications regarding the quantities of artificial manure supplied and may authorize certain employees to sign these certificates on their behalf, as per sections 3(2) and 6(2). Any such authorization must be documented and a copy forwarded to the Secretary of the Department of Commerce. The Regulations impose significant penalties for non-compliance. According to the Act, any person who obtains a payment by means of a false or misleading statement, or who presents any false document or makes any false statement, is liable to a fine not exceeding £500 or imprisonment for a term not exceeding two years. This underscores the importance of accuracy and honesty in the application and certification process.
