This determination is made under subsection 32(1A) of the Primary Industries Research and Development Act 1989 and is essential for calculating the levies attached to the Rural Industries Research and Development Corporation. The total gross value of production determined for these industries amounts to $5,246,794,789.
Scope and Application
The Primary Industries Research and Development (Gross Value of Production—Rural Industries for 2022-23) Determination 2023I applies to primary industries in Australia, specifically those for which a levy is attached to the Rural Industries Research and Development Corporation under the Primary Industries Research and Development Act 1989. This Determination, made by Joanna Stanion, a delegate of the Minister for Agriculture, Fisheries and Forestry, specifies the gross value of production for a range of goods, including buffalo, chicken meat, deer, fodder, ginger, goat fibre, honey, ratites, macropod, pasture seed, rice, tea tree oil, and thoroughbred horses, for the financial year commencing 1 July 2022 and ending 30 June 2023. The total gross value of production for these goods amounts to $5,246,794,789. Key Provisions
The main operative sections of this Determination (C2023G01015) are those which specify the gross value of production (GVP) for various primary industries for the financial year starting 1 July 2022 and ending 30 June 2023. Section 2 outlines the GVP for each industry, as specified in the table within the determination. For instance, Section 2(1) details the GVP for buffalo at $14,695,873, while Section 2(2) specifies the GVP for chicken meat at $3,168,519,216. The table lists the GVP for a range of produce from primary industries, including chicken meat, deer, fodder, ginger, and others, totaling $5,246,794,789.
The obligations and requirements imposed by this Act primarily pertain to the accurate reporting and levying of funds based on the GVP specified. The Rural Industries Research and Development Corporation, established under subsection 9(1) of the Primary Industries Research and Development Act 1989, will use these GVP figures to determine the levies applicable to each industry. This involves ensuring that the data provided in the table is used correctly to levy funds for research and development activities within these industries. The corporations and entities involved must comply with the specified GVP amounts to facilitate the proper allocation of funds for research and development purposes.
Breaches of this Determination could potentially lead to civil or criminal consequences, depending on the nature and severity of the non-compliance. Although the specific penalties are not detailed within this Determination, under the Primary Industries Research and Development Act 1989, breaches can result in financial penalties. For instance, under section 35 of the Act, penalties can be imposed for non-compliance with the provisions of the Act, which can include fines up to a certain monetary limit. The exact penalties would be determined in accordance with the relevant provisions of the Act, and any subsequent legal proceedings or administrative actions taken in response to the breach.
