Overview
The Primary Industries Research and Development (Gross Value of Production of Cotton for 2024-25) Determination 2025I was enacted in 2025 to address the need for precise valuation of the gross value of production of cotton for the financial year beginning on 1 July 2024 and ending on 30 June 2025. This Determination was made by Joanna Stanion, acting as a delegate of the Minister for Agriculture, Fisheries and Forestry, under the authority granted by subsection 32(1A) of the Primary Industries Research and Development Act 1989 (PIRD Act). The legislative framework was further supported by subitem 4(2) of Schedule 4 to the Primary Industries (Consequential Amendments and Transitional Provisions) Act 2024. The policy objective of this Determination is to ensure that the funding for research and development activities within the cotton industry is accurately determined, thereby facilitating the efficient allocation of resources to support industry growth and sustainability.
Scope and Application
This Determination, made under the Primary Industries Research and Development Act 1989, specifies the gross value of cotton production for the financial year 2024-25, applying Commonwealth-wide and relevant to all entities engaged in cotton production within Australia. It serves as an essential tool for calculating the research and development levies for the cotton industry, ensuring that funding is appropriately directed to support advancements and sustainability within this sector. The Determination applies to all individuals and entities involved in the production of cotton, including farmers, cooperatives, and agribusinesses operating in Australia, without distinction between states and territories. This statutory instrument is instrumental in shaping the financial obligations and potential subsidies available to the cotton industry, thereby influencing its economic and research-driven strategies for the forthcoming financial year. Notably, this Determination does not specify any exclusions or exemptions but operates within the broader legislative framework of the PIRD Act, which may include additional provisions or criteria in subordinate instruments.
Key Provisions
The Primary Industries Research and Development (Gross Value of Production of Cotton for 2024-25) Determination 2025I, made by Joanna Stanion, a delegate of the Minister for Agriculture, Fisheries and Forestry, is founded on the authority granted by subsection 32(1A) of the Primary Industries Research and Development Act 1989 (PIRD Act). The determination, which came into effect on 1 July 2024, establishes the gross value of production of cotton for the financial year 2024-25 at $3,294,337,000. This determination is significant as it influences funding and resource allocation for research and development within the cotton industry for the specified financial year.
The obligations and requirements imposed by this determination are primarily centred around the accurate reporting and use of the determined gross value of production figure for cotton. This figure is to be used in conjunction with the provisions of the PIRD Act, ensuring that research and development funding is distributed appropriately based on the economic contribution of the cotton industry. Parties involved, including cotton growers, research institutions, and funding bodies, must adhere to this figure when applying for or allocating research funds. It ensures that the financial resources are correctly aligned with the industry's economic output, which is vital for effective planning and execution of research initiatives.
Failure to comply with the provisions of the PIRD Act and this determination can lead to serious consequences. While the specific offences and penalties are not detailed within this determination, breaches of the PIRD Act can result in civil or criminal penalties. For instance, the Act includes provisions for penalties for providing false or misleading information, which can lead to fines or, in more severe cases, criminal charges. Additionally, any party found to be in breach of the Act's requirements may face legal action, which could further include orders for restitution or compensation. The exact penalties would depend on the nature and severity of the breach, but the potential for significant financial and legal repercussions underscores the importance of strict compliance.
