Overview

The Primary Industries Levies and Charges Disbursement (List of Declared Recipient Bodies) Instrument 2024I was enacted to establish a formal list of bodies eligible to receive funds disbursed under the Primary Industries Levies and Charges Disbursement Act 2024. This legislation aims to address the need for a clear and transparent framework for the allocation of levies and charges collected in the primary industries sector to the appropriate industry bodies. Authorised by subsection 39(9) of the Act and introduced by Anthony Chisholm, Assistant Minister for Agriculture, Fisheries and Forestry, the instrument identifies specific entities responsible for the distribution of funds to respective industry sectors. The overarching policy objective is to ensure efficient and targeted disbursement of funds to bodies that can effectively represent and benefit the industries they serve, thereby supporting the growth and development of Australia's primary industries.

Scope and Application

The Primary Industries Levies and Charges Disbursement (List of Declared Recipient Bodies) Instrument 2024 applies to specific bodies declared as recipient entities under the Primary Industries Levies and Charges Disbursement Act 2024. These bodies, which include entities such as Dairy Australia Limited, Australian Eggs Limited, and Meat & Livestock Australia Limited, among others, are designated as recipients of levies and charges collected from primary industries. The instrument specifies the declared recipient bodies and their corresponding industry bodies for various agricultural sectors, including dairy, eggs, forestry, horticulture, livestock, meat, pork, sugarcane, and wool. This instrument has a national reach, operating across Australia and is effective from 1 January 2025. The instrument does not specify exclusions, exemptions, or thresholds, and its application can be further defined or extended through subordinate instruments made under the authority of the Act.

Key Provisions

The Primary Industries Levies and Charges Disbursement (List of Declared Recipient Bodies) Instrument 2024 (sections 1–5) specifies the declared recipient bodies for the disbursement of levies and charges collected under the Primary Industries Levies and Charges Disbursement Act 2024. Section 1 identifies the instrument as the Primary Industries Levies and Charges Disbursement (List of Declared Recipient Bodies) Instrument 2024, while Section 2 establishes that the instrument commences on 1 January 2025. Section 3 outlines that the instrument is made under subsection 39(9) of the Primary Industries Levies and Charges Disbursement Act 2024. Section 4 provides definitions necessary for interpreting the instrument, including that 'Act' refers to the Primary Industries Levies and Charges Disbursement Act 2024, and 'Declared Bodies Rules' refers to the Primary Industries Levies and Charges Disbursement (Declared Bodies) Rules 2024. Section 5 lists the declared recipient bodies, identifying each body by its name and Australian Business Number (ABN), and specifying the corresponding industry body. The obligations and requirements imposed by the Act on the parties or entities it governs include ensuring that the declared recipient bodies listed in the instrument are eligible to receive disbursements of levies and charges collected under the Act. The declared recipient bodies must meet the criteria set out in the Primary Industries Levies and Charges Disbursement Act 2024 and the Primary Industries Levies and Charges Disbursement (Declared Bodies) Rules 2024. These bodies are responsible for managing and distributing funds in accordance with the Act and must ensure transparency and accountability in their use of the funds. The Act also requires that the disbursements are used for purposes directly related to the primary industries specified, such as research, development, and marketing activities. The Act does not explicitly outline specific offences, penalties, or civil/criminal consequences for breach within the instrument itself. However, breaches of the Primary Industries Levies and Charges Disbursement Act 2024 and the Primary Industries Levies and Charges Disbursement (Declared Bodies) Rules 2024 could potentially lead to enforcement actions under the general provisions of the Act, which may include fines, legal proceedings, and other remedies available under Australian law. The penalties for breaches would be determined based on the specific nature and severity of the breach, as well as any relevant guidelines or regulations set out in the primary legislation. The declared recipient bodies are expected to comply with the requirements set out in the Act to avoid any potential penalties or consequences associated with non-compliance.
