Overview
The Primary Industries Levies and Charges Collection (National Residue Survey – Deer) Regulations 1995, amended up until 1997, were enacted to provide a framework for the collection of the National Residue Survey (NRS) levy from individuals and entities involved in the slaughter of deer. These regulations were created under the authority of the Primary Industries Levies and Charges Collection Act 1991 and the National Residue Survey Administration Act 1992, with the aim of ensuring that levies are collected effectively to fund national residue surveys. The enacting body responsible for these regulations is the Parliament of Australia, which established the legislative framework to facilitate the collection of these specific levies. The policy objective is to support the monitoring and regulation of residues in primary industries, thereby ensuring the safety and quality of agricultural products for both domestic and international markets.
Scope and Application
The Primary Industries Levies and Charges Collection (National Residue Survey — Deer) Regulations, made under the Primary Industries Levies and Charges Collection Act 1991 and the National Residue Survey Administration Act 1992, govern the collection of a National Residue Survey (NRS) levy in relation to the slaughter of deer. This levy applies to all entities involved in the slaughter of deer within Australia, and the rate of the levy is set at 3 cents per kilogram of the weight of the slaughtered deer. The levy is payable in conjunction with the returns required under the Deer Levy Collection Regulations. These regulations mandate that any person lodging a return under the Deer Levy Collection Regulations must also include particulars of the total amount of NRS levy payable on the slaughter of deer to which the return pertains. The Regulations are applicable across the nation and extend their reach to all relevant entities involved in the deer industry, ensuring a comprehensive framework for levy collection and compliance. The Regulations have been amended and consolidated to incorporate changes up to Statutory Rules 1997 No. 366, with specific provisions detailing the application, saving, or transitional arrangements as noted in the statutory rules.
Key Provisions
The Primary Industries Levies and Charges Collection (National Residue Survey — Deer) Regulations (SR 1995 No. 307 as amended) set out the rates and requirements for the National Residue Survey (NRS) levy on deer under the Primary Industries Levies and Charges Collection Act 1991 and the National Residue Survey Administration Act 1992. The regulations establish that the NRS levy rate for deer is 3 cents per kilogram of weight of the slaughtered deer (Reg. 3). Persons lodging returns under the Deer Levy Collection Regulations must include in their returns particulars of the total amount of NRS levy payable on the slaughter of deer to which the return relates (Reg. 4).
The regulations impose obligations on those subject to the NRS levy to ensure accurate reporting and payment. Specifically, those lodging returns under the Deer Levy Collection Regulations must provide accurate details of the total NRS levy payable in relation to the slaughter of deer. This includes providing particulars of the total amount of the NRS levy in the return (Reg. 4). These obligations are designed to ensure that the necessary funds are collected to support the National Residue Survey, which monitors chemical residues in animals and animal products.
Failure to comply with the requirements of the regulations may result in penalties. Under section 24 of the Primary Industries Levies and Charges Collection Act 1991, a person who contravenes a provision of the regulations is liable to a penalty. The specific penalty may vary depending on the nature and severity of the breach but is intended to enforce compliance with the levy requirements. Additionally, the regulations reference other provisions in the Deer Levy Collection Regulations (Regs. 13, 15, 16, and 17) that detail further requirements relating to returns and records in relation to the slaughter of deer. These provisions further clarify the obligations and may also include penalties for non-compliance.
