Section 8 of the Primary Industries (Excise) Levies Act 1999 provides that the Governor-General may make regulations prescribing matters required or permitted by that Act to be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to that Act.

Section 8 of the Primary Industries (Customs) Charges Act 1999 provides that the Governor-General may make regulations prescribing matters required or permitted by that Act to be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to that Act.

Section 3 0 of the Primary Industries Levies and Charges Collection Act 1991 provides that the Governor-General may make regulations prescribing matters required or permitted by that Act to be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to that Act.

The purpose of the Primary Industries Levies and Charges Collection (Buffalo, Cattle and Livestock) Repeal Regulations 2000 (the Repeal Regulations) is to repeal the Primary Industries Levies and Charges Collection (Buffalo, Cattle and Live-stock) Regulations 1998 that were made under those Acts listed in proposed regulation 3 of the Repeal Regulations. Those Acts were repealed by the Primary Industries Levies and Charges (Consequential Amendments) Act 1999 and National Residue Survey Administration Amendment Act 1998.

In spite of the repeal of those Acts, those regulations in the Primary Industries Levies and Charges Collection (Buffalo, Cattle and Live-stock) Regulations 1998 that were made under the repealed Acts (except for regulations made under the NRS Acts) were saved by transitional clauses in the Primary Industries (Excise) Levies Act 1999 and Primary Industries (Customs) Charges Act 1999. The saving of those regulations was necessary pending the migration of those regulations to regulations made under the Primary Industries (Excise) Levies Act 1999 and Primary Industries (Customs) Charges Act 1999. The process of migrating those regulations is being done by way of the Primary Industries (Excise) Levies Amendment Regulations 2000 (No. 1) and Primary Industries (Customs) Charges Regulations 2000. The balance of the provisions in the Primary Industries Levies and Charges Collection (Buffalo, Cattle and Live-stock) Regulations 1998 are being migrated to regulations under the Primary Industries Levies and Charges Collection Act 1991 by means of the Primary Industries Levies and Charges Collection Amendment Regulations 2000 (No. 1). It follows that the Primary Industries Levies and Charges Collection (Buffalo, Cattle and Live-stock) Regulations 1998 are no longer necessary and should be repealed. The Repeal Regulations effect that repeal.

Proposed regulation 4 of the Repeal Regulations is a savings provision that removes any doubt that any obligation in existence under the Primary Industries Levies and Charges Collection (Buffalo, Cattle and Live-stock) Regulations 1998 in-immediately before the commencement of the Repeal Regulations continues to apply.

The Primary Industries (Excise) Levies Amendment Regulations 2000 (No. 1), Primary Industries (Customs) Charges Regulations 2000, Primary Industries Levies and Charges Collection Amendment Regulations 2000 (No. 1) and the Repeal Regulations are made concurrently and have as their date of commencement 1 July 2000.

The Repeal Regulations commence on 1 July 2000.

 

Overview

The Primary Industries Levies and Charges Collection (Buffalo, Cattle and Livestock) Repeal Regulations 2000 (the Repeal Regulations) were enacted to address the repeal of the Primary Industries Levies and Charges Collection Act 1991, Primary Industries (Excise) Levies Act 1999, and Primary Industries (Customs) Charges Act 1999, which collectively regulated levies and charges on buffalo, cattle, and livestock within Australia's primary industries sector. These Acts were repealed by the Primary Industries Levies and Charges (Consequential Amendments) Act 1999 and the National Residue Survey Administration Amendment Act 1998. Despite the repeal, certain regulations under the Primary Industries Levies and Charges Collection Act 1991 were preserved under transitional clauses in the Primary Industries (Excise) Levies Act 1999 and Primary Industries (Customs) Charges Act 1999 until they could be migrated to new regulations under the newer Acts. The Repeal Regulations thus serve to formally repeal the outdated Primary Industries Levies and Charges Collection (Buffalo, Cattle and Livestock) Regulations 1998, aligning the regulatory framework with the current legislative environment and ensuring a smooth transition to the new regulatory regime.

Scope and Application

The Primary Industries Levies and Charges Collection (Buffalo, Cattle and Livestock) Repeal Regulations 2000 applies to the repeal of the Primary Industries Levies and Charges Collection (Buffalo, Cattle and Livestock) Regulations 1998 that were made under the repealed Primary Industries (Excise) Levies Act 1999, Primary Industries (Customs) Charges Act 1999, and Primary Industries Levies and Charges Collection Act 1991. The Repeal Regulations are made pursuant to the authority provided in section 8 of each of the Acts mentioned. The purpose of these Regulations is to formally repeal the 1998 Regulations, as the underlying Acts have been repealed, but some of the provisions were saved pending their migration to new regulations under the Primary Industries (Excise) Levies Act 1999 and Primary Industries (Customs) Charges Act 1999. The Regulations have a national jurisdictional reach, applying across Australia, and are effective as of 1 July 2000. Any obligations existing under the repealed 1998 Regulations immediately before the commencement of the Repeal Regulations continue to apply, as clarified by the savings provision in regulation 4.
