STATUTORY RULES 2004 No. 106

Issued by the Authority of the Parliamentary Secretary to the Minister for Agriculture, Fisheries and Forestry

Primary Industries (Excise) Levies Act 1999

Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3)

Section 8 of the Primary Industries (Excise) Levies Act 1999 (the Excise Act), provides that the Governor-General may make regulations prescribing matters required or permitted by that Act to be prescribed or necessary or convenient to be prescribed for carrying out or giving effect to that Act.

Sub clause 14 (2) of Schedule 27 to the Excise Act provides that if there is a body designated in relation to a particular product, and before the Governor-General makes regulations, the Minister must take into consideration any relevant recommendation made to the Minister by the designated industry body.

The regulations implement a compulsory levy on certain products to fund industries' cost sharing obligations under the Emergency Animal disease Response Agreement for the chicken meat and egg industries. The Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3) will set an operative rate of levy. Collection arrangements will be identical to those for existing levies.

The establishment of government/industry cost sharing arrangements for emergency animal disease outbreaks is jointly supported by the Commonwealth government, State and Territory governments and industry. The money raised by a levy will be used to repay respective livestock industry debts to the Commonwealth government following those industries' request for the Commonwealth to underwrite their share of costs.

The Office of Regulation Review has been consulted and has advised that a Regulation Impact Statement is not necessary for the legislation (RIS ID number 5721).

Details of the regulations, namely, the Excise regulations, are contained in the Attachment.

The regulations commence on 1 July 2004.

Overview

The Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3) were enacted to implement a compulsory levy on specific products, notably eggs and chicken meat, aimed at funding the industries' cost-sharing obligations under the Emergency Animal Disease Response Agreement. These regulations were introduced to address the financial burden placed on the chicken meat and egg industries in response to emergency animal disease outbreaks. Enacted by the Australian Parliament and authorised by the Parliamentary Secretary to the Minister for Agriculture, Fisheries and Forestry, these regulations seek to ensure a fair distribution of costs between the government and the industry. The policy objective is to facilitate a joint cost-sharing arrangement for emergency animal disease outbreaks among the Commonwealth government, State and Territory governments, and industry stakeholders, ensuring that the industries can effectively manage their financial obligations. The regulations were established following consultations with the Office of Regulation Review, which determined that a Regulation Impact Statement was not necessary for these specific amendments. These regulations came into effect on 1 July 2004, with the aim of setting a new operative rate for the Emergency Animal Disease Response levy. The collection arrangements for the levy mirror those of existing levies, ensuring consistency and ease of implementation. The funds raised through this levy will be used to repay industry debts to the Commonwealth government, reflecting a collaborative effort to manage and mitigate the financial impact of emergency animal disease outbreaks.

Scope and Application

The Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3) apply to the entities within the chicken meat and egg industries, specifically targeting those involved in the production and sale of these products. The geographic reach of these regulations is national, as they are implemented under the Commonwealth's authority, and are intended to facilitate the funding mechanism agreed upon by the Commonwealth government, State and Territory governments, and industry stakeholders. The regulations are designed to enforce a compulsory levy on certain products to fund the industries' cost-sharing obligations under the Emergency Animal Disease Response Agreement. The application of these regulations is restricted to the levy rates specified for eggs and chicken meat, with the collection arrangements mirroring those for existing levies. The implementation of these regulations is based on a consensus reached through consultations with relevant industry bodies, ensuring that the views and recommendations of the designated industry bodies are considered by the Minister before the Governor-General makes the regulations.

Key Provisions

The Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3) (the Regulations) amend the Primary Industries (Excise) Levies Regulations 1999 (the 1999 Regulations). Regulation 1 sets the name of the Regulations as the Primary Industries (Excise) Levies Amendment Regulations 2004 (No. 3), and Regulation 2 sets the Regulations to commence on 1 July 2004. Regulation 3 amends the 1999 Regulations by inserting new rates for the Emergency Animal Disease Response (EADR) levies for eggs and chicken meat, as detailed in Schedule 1. Specifically, the EADR levy for eggs is set at 1.5 cents per laying chicken, and the EADR levy for chicken meat is set at 0.033 cents per meat chicken. The Regulations impose obligations on producers of chicken meat and eggs to comply with the new EADR levy rates, which are designed to fund the industries' cost-sharing obligations under the Emergency Animal Disease Response Agreement. Producers must ensure that the levies are calculated correctly and paid in accordance with the established collection arrangements, which are identical to those for existing levies. These obligations are essential for the proper functioning of the cost-sharing arrangements supported by the Commonwealth government, State and Territory governments, and industry. Breaches of the Regulations may result in civil and criminal consequences. While the specific penalties are not detailed in the Explanatory Statement, under the Primary Industries (Excise) Levies Act 1999, non-compliance with excise duties and levies can result in significant penalties, including fines that can be substantial, depending on the nature and extent of the breach. The severity of penalties may vary, but they are intended to ensure compliance with the regulatory framework governing the collection and management of EADR levies.
