Overview
The Norfolk Island Pounds Regulations, enacted in 1935, were established to provide a comprehensive framework for the impounding and management of livestock on Norfolk Island. These regulations were introduced to address the need for clear and consistent procedures regarding the impounding of stock, ensuring that stock owners could be notified and that unclaimed stock could be managed effectively. The regulations are made under the authority of the Norfolk Island Administration and are designed to support the administration of the Pounds Act 1934. The overarching policy objective is to facilitate the orderly management of stock on the island, ensuring transparency and accountability in the impounding process.
The regulations specify the procedures for impounding stock, requiring any person who impounds stock to notify the poundkeeper in accordance with a prescribed form. Additionally, the regulations mandate that notices of impounding be posted at the pound and near the Court House if the stock is not claimed within 24 hours. The poundkeeper is required to maintain a Pound Book, documenting all relevant details of impounded stock, including the time, description, cause of impounding, and the owner or supposed owner. These provisions ensure that there is a clear and accessible record of all impounded stock, supporting the effective management and eventual resolution of impounding incidents.
Scope and Application
The Norfolk Island Pounds Regulations, which are a subset of the Norfolk Island Continued Laws Ordinance 2015, govern the process and procedures surrounding the impounding of stock on Norfolk Island. These regulations apply to any person who impounds any stock in a pound, requiring them to provide notice to the poundkeeper as per the specified forms in the Schedule. The geographic scope of these regulations is confined to Norfolk Island. Additionally, the poundkeeper must post a notice of any stock that remains unclaimed by the owner or a representative within 24 hours at the pound and near the Court House. The poundkeeper is also mandated to maintain a Pound Book, recording all relevant details of impounded stock, and submit monthly returns of any fees received to the Accountant, Norfolk Island Administration. These regulations, while they primarily focus on the administrative aspects of stock impoundment, do not explicitly state any exclusions, exemptions, or thresholds. The application of these regulations can be extended or restricted through subordinate instruments, as indicated by the various amendments listed in the consolidation.
Key Provisions
The Norfolk Island Pounds Regulations (2019) provide specific guidelines on the handling of impounded stock on the island. According to Regulation 2, any person who impounds stock in a pound must notify the poundkeeper using Form 1 in the Schedule. This form requires details such as the kind of stock, number of animals, colour, particular marks, brand, and the name of the owner or supposed owner. Regulation 3 mandates that a notice of the impounding of stock must be posted at the pound and near the Court House by the poundkeeper, if the stock is not claimed within 24 hours. Form 2 in the Schedule outlines the required information for this notice, including details of the impounded stock and a warning that the stock will be sold if not claimed.
These Regulations impose several obligations on the parties involved. The poundkeeper is required to maintain a Pound Book in accordance with Form 3 in the Schedule, detailing all impounded stock, the circumstances of the impounding, and the subsequent release or sale of the stock. This record must be updated promptly, and all fees collected must be accounted for in a monthly return to the Accountant of the Norfolk Island Administration. Failure to comply with these requirements could lead to administrative penalties or other consequences as determined by the Norfolk Island Administration.
While the Regulations themselves do not explicitly outline specific offences, penalties, or civil/criminal consequences for non-compliance, breaches of these provisions could potentially lead to enforcement actions under the Pounds Act 1934. Such actions might include fines, administrative penalties, or other corrective measures to ensure compliance with the legislative intent and administrative requirements. The precise nature and extent of any penalties would be determined based on the specific circumstances of the breach and the relevant provisions of the Pounds Act 1934.
