Overview
The Poultry Industry Levy Regulations 1967, made under the authority of the Poultry Industry Levy Act 1965-1966, address the need for a structured and regulated approach to levy collection within the poultry industry. Enacted by the Governor-General in Council, these regulations provide a detailed framework for the collection of levies imposed on owners of hens, ensuring compliance with the legislative intent of the Act. The policy objective of these regulations is to facilitate the orderly collection of levies while providing clear guidelines for poultry industry stakeholders on the process of making an election to have the levy apply during a specified period. This legislative instrument aims to streamline the administrative processes involved in levy collection, thereby supporting the broader goals of the Poultry Industry Levy Act.
Scope and Application
The Poultry Industry Levy Regulations, made under the Poultry Industry Levy Act 1965-1966, apply to the owners of hens within Australia. These regulations pertain specifically to the method by which an owner of broiler breeder hens may make an election under the Act. For hens kept in the Australian Capital Territory, the election must be submitted to the Senior Finance Officer of the Department of Primary Industry, whereas for hens kept in any state, the election must be made to the Secretary of the relevant State Egg Board. These regulations are designed to streamline the process for owners to elect certain provisions of the Act, ensuring clarity and compliance with the levy requirements. The regulations also provide a form for the election instrument, which must be completed and signed by the owner, specifying the date from which the election is to apply. The scope of the regulations is limited to the procedural aspects of making an election under the Act, and they do not alter the substantive provisions of the Act itself.
Key Provisions
The Regulations under the Poultry Industry Levy Act 1965-1966, particularly Regulation 5, provide a framework for the owner of hens to make an election in accordance with section 8 of the Act. This election pertains to the application of certain provisions related to the levy imposed on hens, and the owner must submit a written instrument to either the Senior Finance Officer of the Department of Primary Industry if the hens are in the Australian Capital Territory, or to the Secretary of the State Egg Board if the hens are located in a state (Regulation 5(1)). The term 'State Egg Board' is defined as per the Poultry Industry Levy Collection Act 1965-1966 (Regulation 5(2)).
The obligations imposed by these regulations are clear and straightforward. The owner of hens must furnish a written instrument to the relevant authority to make the election as provided under the Act. This instrument must be completed in accordance with the form specified in the Schedule to the Regulations (Regulation 5(1)). The content of this instrument should specify the owner’s full name, address, and the date from which the levy provisions should apply, along with the applicable paragraph of the sub-section in section 8 of the Act (Schedule). The owner must sign this document to formalise the election.
Non-compliance with these regulations can result in significant consequences. While the specific penalties for breach are not detailed within the Regulations, it is reasonable to infer that breaches could lead to penalties under the primary Act or related legislation. Generally, penalties for non-compliance in such regulatory frameworks can include fines, enforcement actions, or other civil or criminal penalties as deemed appropriate by the relevant authorities. The exact penalties would be aligned with the severity of the breach and the jurisdictional laws in place at the time of the offence.
