Overview
The Poultry Industry Levy Regulations 1980, made under the Poultry Industry Levy Act 1965, were introduced to establish a consistent rate of levy for the poultry industry. Enacted by the Governor-General in accordance with the advice of the Federal Executive Council and based on a recommendation by the Council of Egg Marketing Authorities of Australia, these regulations aimed to set the levy at 7.5 cents for each hen per day, effective from 1 July 1980. This legislative instrument was designed to ensure a uniform rate of levy as recommended, thereby providing clarity and predictability in the financial obligations of the poultry industry.
Scope and Application
The Poultry Industry Levy Regulations 1980, made under the Poultry Industry Levy Act 1965, apply to entities involved in the poultry industry, specifically those who are required to pay a levy for each hen within the Commonwealth of Australia. The regulations establish the prescribed rate of levy, which was last recommended by the Council of Egg Marketing Authorities of Australia, at 7.5 cents per hen for each prescribed day on or after 1 July 1980. The scope of the regulations is limited to the imposition of this levy and does not extend to other areas of the poultry industry unless further specified by subordinate instruments. These regulations were made to ensure compliance with the recommendations of the Council of Egg Marketing Authorities of Australia and to provide clarity and consistency in the application of the levy across the poultry industry in Australia.
Key Provisions
The main operative sections of these Regulations under the Poultry Industry Levy Act 1965 pertain to the adjustment of the prescribed rate of levy, as well as the commencement of the amendment. Regulation 2 specifies that the amendment will come into effect on 1 July 1980. Regulation 3 amends the prescribed amount of the levy, replacing the previous rate of 7 cents with a new rate of 7.5 cents per hen per prescribed day. This adjustment is in accordance with the recommendation made by The Council of Egg Marketing Authorities of Australia to the Minister, and it ensures that the rate does not exceed the most recent recommendation.
These Regulations impose specific obligations on parties or entities within the scope of the Poultry Industry Levy Act 1965. The amendment to the prescribed rate of levy requires that all levies collected from 1 July 1980 onwards be calculated at the new rate of 7.5 cents per hen per prescribed day. This change mandates that those responsible for levy collection and payment, such as poultry farmers and egg producers, must adjust their calculations and payments to reflect the new rate. Furthermore, entities such as the Council of Egg Marketing Authorities of Australia and the Minister must ensure that the new rate is implemented correctly and that any recommendations for future rates are made in a timely manner.
In the event of non-compliance with the amended Regulations, there may be legal consequences for the parties or entities involved. While the specific offences, penalties, or consequences are not detailed within the Regulations themselves, breaches of the Poultry Industry Levy Act 1965 or its Regulations could result in civil or criminal penalties under Australian law. For example, penalties may include fines or other sanctions for failure to accurately calculate and pay the prescribed levy, or for non-compliance with other requirements of the Act. The exact penalties would depend on the nature and severity of the breach, as well as any relevant provisions in the Act or associated legislation.
