Overview
Statutory Rules 1974 No. 177, made under the Poultry Industry Levy Collection Act 1965-1966, were enacted to facilitate the updating of specific locations in the Second Schedule of the Poultry Industry Levy Collection Regulations. This legislative instrument was introduced to address the need for current and accurate address information to ensure the efficient collection of levies within the poultry industry. The regulations were made by the Governor-General of Australia, acting with the advice of the Executive Council, and the policy objective was to maintain up-to-date administrative details necessary for the levy collection process. This amendment ensures that levy collection activities are correctly directed to the appropriate entities, thereby supporting the operational integrity of the poultry industry.
Scope and Application
The Poultry Industry Levy Collection Regulations 1974, enacted under the Poultry Industry Levy Collection Act 1965-1966, apply to all entities involved in the poultry industry within Australia, including poultry producers, processors, and other relevant stakeholders. These regulations are designed to facilitate the collection of the poultry industry levy as specified by the Act, ensuring that the financial obligations of industry participants are clearly defined and enforced. The geographic reach of these regulations is nationwide, encompassing all states and territories within Australia, thereby providing a consistent framework for levy collection across the country. Notably, the regulations include amendments to specific address details for levy collection points, reflecting administrative updates rather than substantive changes to the scope or application of the levy. The regulations do not explicitly state exclusions, exemptions, or thresholds, implying that the levy applies broadly to all participants within the scope of the Act unless otherwise specified through subordinate instruments.
Key Provisions
The main operative sections of the Statutory Rules 1974 No. 177 pertain to the amendments of the Poultry Industry Levy Collection Regulations under the Poultry Industry Levy Collection Act 1965-1966. The regulation, dated the first day of October 1974, involves changing the addresses where certain administrative functions are to be carried out. Specifically, section 1(a) of the Second Schedule replaces the previous address "49 Flinders Street, Adelaide" with "41-45 West Beach Road, Keswick, 5035". Similarly, section 1(b) replaces "26 John Street, West Perth" with "43-53 McGregor Road, Palmyra, 6157". These changes are intended to ensure that any correspondence or administrative processes related to the Poultry Industry Levy are directed to the correct locations.
The amended regulations impose certain obligations on the parties governed by them. These obligations primarily involve ensuring that all communications, filings, or other administrative actions are directed to the new addresses specified in the regulations. For instance, any entity required to submit documentation or pay levies must now direct their correspondence to "41-45 West Beach Road, Keswick, 5035" or "43-53 McGregor Road, Palmyra, 6157" as appropriate. This change is administrative and aims to streamline the processing of Poultry Industry Levy-related matters by having a centralised and updated address for all communications.
Regarding the consequences of non-compliance with the amended regulations, the Statutory Rules 1974 No. 177 do not explicitly state any specific offences, penalties, or consequences for breach. However, it is reasonable to infer that failure to adhere to the updated addresses could lead to delays or complications in processing levies or other related administrative tasks. While the regulations themselves do not specify penalties, any resultant delays or administrative issues might indirectly impact the operations of those subject to the Poultry Industry Levy Collection Act 1965-1966. For more detailed information on potential penalties or consequences, reference should be made to the main Act or relevant legal interpretations.
